Question about i765- sending with i485 & i130 ?

So we're almost ready to send i485 & i130. Do you NEED to send i765 to get an employment card? i don't understand, i thought that they do automatically send you one within 2 months after you apply for an adjustment of status. Is it true? Someone please explain.

6/19/2013- ALL Forms Sent to Chicago Lockbox- (i485, i130 with rest)

 

 

6/21/2013- Package received in Chicago Lockbox

 

 

6/26/2013- Email and Text Notification received in the evening- Package received and accepted at USCIS smile.png

 

 

6/28/2013- They cashed the checks- $420 + $1070 = $1490 smile.png

 

 

7/2/2013 - USCIS Mail notification received (all the forms are received and are in process)

 

 

 
7/3/13- Biometrics letter received- for 7/19/13- Day 13
 
7/9/13 - Early biometrics done! - Day 19

 

 

8/5/13 or so - Status changed for Ready for scheduling

 

 

8/20/2013 - INTERVIEW SCHEDULED FOR 9/20/2013

 

 

8/21/2012 - Interview Cancelled! ;(

 

 

8/22/2013 - 2nd interview scheduled for 24th September.

 

 

8/27/2013 - Online update - EAD card ordered!

 

 

9/5/2013 - EAD card received

They won't send it to you if you don't apply, no.

Nothing is automatic. If you want the EAD, then you have to apply for it.

And the time frame is 3 months, NOT 2 months.

March 26, 2009: We become a couple!
September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!
June 21, 2010: Engaged!!!
September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Send everything together, including the i-864. You will only waste time and possibly money if you don't.

There is no fee for the I-765 when filed in conjunction with an adjustment of status application.

Spouse-based AOS from out-of-status H-1B, May - Aug 2012

Removal of conditions, Aug - Nov 2014

Yes, don't send an incomplete package. Everything will be put on hold until you send the I-864 in anyway, so you gain nothing by sending in an incomplete package.

You have to send I-765 along with I-130 and I-145 if you would like to work. No, they don't send things automatically...in America you have to pay for everything....it's all about money. LOL :) And if you know you might leave the country then you should apply for I-131. But if you know you won't be leaving the States at all, you don't need to. I didn't apply for it as I knew I won't be going anywhere. Good luck!
