Questions about my Wife's Philippines citizenship

My wife and I are newly married and while this may seem far out I need some guidance in how her Philippine citizenship is affected by our marriage here in the USA.

We both know that when our retirement’s comes we will be returning to Negros Oriental in the Philippines and wanted to know once her time reaches 10+ years and we have filed all our paperwork and she becomes a citizen does she loose her Philippine citizenship and all the benefits that comes with it.

The ability to buy land is the most important as we are thinking on a few ventures and the land will be essential as renting land is a sure fire way to see your business rise and then crumble.

If anyone can post a forum or give advice as to how they handled this, relocating back to the Philippines and starting a business after completing a k1 visa I would greatly appreciate this info.

April 15, 2013 - I-129F sent to USCIS
April 17, 2013 - I-129F delivered
April 19, 2013 - NOA1
April 23, 2013 - Alien Registration Number was changed
June 17, 2013 - Second Visit
July 31,2013 - RFE
August 06, 2013 - Return to US
August 08, 2013 - RFE reply sent. ( next day delivery service)
August 09, 2013 - RFE response received
August 13, 2013- APPROVED!
12nn - Received an email from Representative Staff that our petition is approved already. ( w/ email from USCIS officer )
8pm - Received email confirmation about the approval & Online Status Updated.
August 14,2013- got my BC & Cenomar ( waited 5mins for BC & almost 1 1/2hr for Cenomar)
August 15, 2013 - got my NBI ( total processing time from step 1 to releasing 1 1/2hrs)
August 23,2013 - CFO Attended, Got GCC. Sticker to follow.
Sep 18, 2013 - Got MNL Case # via Phone & Paid Visa Fee @ BPI
Sept 23, 2013 - Medical PASSED - 1 Day Only

Sep 24, 2013 - Case status " READY"
Oct 07, 2013 - Interview - APPROVED
Oct 08,2013 - Status changed AP then ISSUED

Oct 10, 2013 - Status @ 2go site - HOLD for Pick up

Oct. 16, 2013 - US Entry @ LAX

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Good question. I'm not 100% sure but throwing it out there so someone who knows will answer. If she gets a US passport she still has her filipino passport. I believe you never lose citizenship

Your wife will first receive her permanent resident card (green card). She can be a permanent resident for years and years...and never apply for U.S. citizenship.

However, if she chooses to become a U.S. citizen, she renounces all allegiances (Philippines) and effectively loses her Philippine citizenship.

According to Philippines' Citizenship Retention and Re-acquisition Act, you may then maintain your Philippine citizenship. Under their modified Oath of Allegiance, applicants for dual citizenship swear to support and defend the Constitution of the Republic of the Philippines. Nowhere in the Oath is there any renouncing of allegiance.

Are you referring to you? Or your wife?

Once your Filipino spouse reaquires Philippine citizenship, the person has dual citizenship (U.S. citizen and Philippine citizen).

If you're referring to yourself, you most certainly can attain Philippine citizenship. BUT...this would require renouncing and giving up your U.S. citizenship.

The dual citizenship is only for former Filipinos. These applicants do not renounce their U.S. citizenship, but do swear allegiance to the Philippines.

IMHO, renouncing your U.S. citizenship for Philippine citizenship is not a good idea. Just my thoughts.

First half is my wife coming here. Second half is when we return there to live, with me going through the process. So basically we'll both go through an immigration process.

My wife never really wanted to leave the Philippines, and if she didn't think I wanted to return to her country eventually, I doubt she would have came at all.

But I am looking forward to the day I can mess with the locals that a tall blonde guy is a Filipino rofl.gif

The USA allows you to pick up citizenship in other countries. You just can't fight in their military against USA interests or I believe run for national office in the second country.

Marriage has zero affect on your wife's citizenship in the Philippines. Your wife getting a green card has zero affect on your wife's citizenship.

Your will can obtain her U.S. citizenship three (3) years after she first gets her green card, as long as she is married to you, this affects her Philippine citizenship. Once she becomes a citizen of the USA she can do her dual citizenship through the Philippine consulate very easily.

I doubt I would ever bother getting (dual) Philippine citizenship, getting the 13A visa is more than adequate for living there long term. The second you obtain Philippine citizenship should you have a serious "issue" the option of contacting the embassy will be tossed out the window.

I doubt I would ever bother getting (dual) Philippine citizenship, getting the 13A visa is more than adequate for living there long term. The second you obtain Philippine citizenship should you have a serious "issue" the option of contacting the embassy will be tossed out the window.

Foreigners cannot get dual citizenship. Dual citizenship is only for former Filipinos. Not their spouses.

You can get Philippine citizenship by way of renouncing your U.S. citizenship. You will lose your U.S. citizenship, and will become a Filipino citizen...not a dual citizen.

I agree, the 13A visa is great if living there long term. For me, even the Balikbayan visa is adequate.

There is one important thing to remember for foreigners getting Philippine citizenship and giving up their U.S. citizenship. If ever you needed to return to the U.S. (e.g. death in the family), you will most likely need to apply for a tourist visa. Remember, you will be a Filipino now...even if you are white. laughing.gif U.S. will treat you like any other citizen of a foreign country. And you will need certain types of visa to lawfully enter the U.S. Just something to consider. unsure.png
