I could be wrong, but I believe your received date on your NOA-1 is the priority date.

2013-03-29: Paid for a service through RapidVisa & began to prepare paperwork.
2013-04-11: Sent all the necessary documents to RapidVisa for review.
2013-04-12: Signed my application in red ink, so I had to overnight RapidVisa my application signed in BLUE ink.
2013-04-15: RapidVisa reviewed my application, found no fault and sent the I-129F Application to the Texas Lockbox.
2013-04-17: Electronic notification that the application was forwarded to the VT Service center.
2013-04-19: NOA-1 Received (snail mail) with the wrong country of birth for the foreign Partner. Notice date was 2013-04-15.

2013-04-19: Electronic Notification Received that an Alien Registration Number (ARN) was assigned to Foreign Partner.
2013-04-22: Called USCIS and corrected the typographical error on the NOA1.
2013-04-30: Received notification that the typographical error on the NOA1 has been corrected in the electronic system, but the error was minor and will not affect my application, as it is still valid.

mune25, calm down dear. It won't hurt anything to withdraw a petition and refile.

They don't need, nor care for a reason, and if later on down the road, anyone asks why you withdrew you petition, simply state that it was a paperwork error, and explain the situation, keep the original files from the first petition so you can provide evidence to support your reasoning.

Just submit a letter for a request to withdraw your petition. You'll have to pay the fee again, and start all over, but it won't hurt your chances next time. They would rather you withdraw and re-apply than waste resources on what you know could be a bad application.

My spanish is horrible but I'll try a translation for you:

Cálmate querida. No va a doler nada de retirar una solicitud y volver a presentarla.

No es necesario, ni la atención por una razón, y si más adelante en el camino, alguien pregunta por qué te retiraste petición, se limitan a afirmar que se trataba de un error de papeleo, y explicar la situación, mantener los archivos originales de la primera petición para que pueda aportar pruebas para apoyar su razonamiento.

Simplemente envíe una carta de solicitud de retirar su petición. Vas a tener que pagar la cuota de nuevo y empezar todo otra vez, pero no va a perjudicar sus posibilidades la próxima vez. Ellos prefieren que retirarse y volver a aplicar los recursos de los residuos en lo que sabes podría ser una mala aplicación.

De nada. La fecha de prioridad sería la fecha de recibido en su primera notificación de acción. Una cosa que recomendaría es tener su prometido configurar una cuenta de Google Drive y analizar todos los documentos que se envían y recibimos el K1 a ella, y que ellos te vinculan a la misma, por lo que siempre se puede ver lo que está pasando. Esto ayuda a Gabriel y yo cuando tenemos que trabajar juntos como un equipo.

Replace the red stuff with your own information. If you don't have an Alien Registration Number (ARN) yet, don't include it. The priority date I'm pretty sure is the receipt date on your NOA-1.

You should withdraw the petition, otherwise as people have commented you may jeopardise ever being together.

The two strictest criteria that are shown regarding K1 are (a) you have known each other for two years and have met, unless hardship prevented you from doing so (b) neither of you is married.

When we submitted our I-129F petition we had to wait eight months for my divorce to be finalised (a decree absolute) of course now like everyone else we are enduring further waiting. But the most important part of this process is to be accurate, truthful and adhere to the information and criteria asked for. Then of course there is patience, of which you will need an abundance of. If your relationship is genuine, then all of this waiting and hardship is a unfortunate necessity.

Hi! I just want to clear up a common misconception here! You do not have to know your fiance(e) for two years, you only have to have met within the last two years.

Good luck on your journey though! I'm lucky I was already divorced when I met my fiance. :)

I have withdrawn a petition for almost the exact same reason. I'm the petitioner and my fiance was the beneficiary. Unknown to me, she was still married in Iceland (of all places). I withdrew the petition exactly has been described here...a brief, simple letter requesting the petition be withdrawn...no reason given.

When I refiled the petition (after helping her get divorced), I did write a short note for Question 11 of the 129F.

Question 11: Have you ever filed for this or any other alien fiancé or husband/wife before.

Answer: Yes

I filed the original I-129f Petition dated September 17, 2012 for the same beneficiary, _________. It was submitted to the USCIS office in Lewisville, TX. On September 21, 2012 I received Form I-797C, Notice of Action from the Dept. of Homeland Security - Vermont Service Center. The receipt number is ___________

The original submission was what I knew to be accurate at the time I submitted the Petition. Subsequently, I became aware that I had unintentionally misrepresented _______ previous marital status. As a result, I sent a letter to the USCIS dated November 21, 2012 asking for my petition to be withdrawn. That request was granted.

The issue has been resolved and corrected on the current Petition.

Not sure if that's too much information or not but I thought honesty was the best approach on this issue.
