LEGALLY MARRIED BEFORE SEND THE PETITION K 1 AFTER CAME THE DOCUMENT DIVORCE

my petition for fiance k1 was send to 5 month all ok, the big problem is my fiance not wrote that he divorced, he write was single, becouse your document legally of your divorced no have in your hands, after the my petition month came , that big problem no was legally divorced when he send to the petition . wow




we do? withdraw the petition? and send a new one, and if so how much long to wait? or continue with the process and hope that uscis send RFE there maybe a problem when uscis see the date of the decrets for your divorce look at the date of the judgment of divorce that is after the my petition , .. In this moment He divorced Now but when he send the petition He was legally married , your act of he your divorced came after the petition for me have the problem?

Withdraw immediately. I do not know how long that takes or how it can be confirmed it is officially withdrawn (perhaps others can tell of this process). But once it is, then refile - basically you are starting over. It's not the end of the world, but it just means you go to the back of the line and through it again.

You need to withdraw the petition immediately. If they look at the petition and find out his was still married when you filed he may be charged with misrepresentation and banned from EVER coming to the US.

This will not be over quickly. You will not enjoy this.

There's a high likelihood that they will deny the K1 visa for misrepresenting the facts. You can take the risk and hope they'll forgive your oversight, but if they don't either the K1 will be denied at best, or at worst they can decide that you are banned from ever coming to the US.

Your safest bet (and probably shortest at this point) is to withdraw your petition, wait for however long is necessary, and re-file for it when available. You will end up 5 months behind, but its better than being banned, or denied and having to refile in another 4-7 months, thus wasting more time.

2013-03-29: Paid for a service through RapidVisa & began to prepare paperwork.
2013-04-11: Sent all the necessary documents to RapidVisa for review.
2013-04-12: Signed my application in red ink, so I had to overnight RapidVisa my application signed in BLUE ink.
2013-04-15: RapidVisa reviewed my application, found no fault and sent the I-129F Application to the Texas Lockbox.
2013-04-17: Electronic notification that the application was forwarded to the VT Service center.
2013-04-19: NOA-1 Received (snail mail) with the wrong country of birth for the foreign Partner. Notice date was 2013-04-15.

2013-04-19: Electronic Notification Received that an Alien Registration Number (ARN) was assigned to Foreign Partner.
2013-04-22: Called USCIS and corrected the typographical error on the NOA1.
2013-04-30: Received notification that the typographical error on the NOA1 has been corrected in the electronic system, but the error was minor and will not affect my application, as it is still valid.

Explain a mistake was made, please withdraw the first petition, and accept this new one, with a new check, of course. Or can a withdrawal be made for a petition at an info pass?

Explain a mistake was made, please withdraw the first petition, and accept this new one, with a new check, of course. Or can a withdrawal be made for a petition at an info pass?

I have withdrawn a petition and refilled

do not send them together

the original withdrawal needs to go to the center that has your file..you will probably have to confirm this with a phone call to an IO at uscis

the written response will come to you within a month

then refile

He only needs to send a letter to the service center that is processing his petition and tell them he wishes to withdraw the petition. He does not have to give a reason or explain in detail.

mune25, calm down dear. It won't hurt anything to withdraw a petition and refile.

They don't need, nor care for a reason, and if later on down the road, anyone asks why you withdrew you petition, simply state that it was a paperwork error, and explain the situation, keep the original files from the first petition so you can provide evidence to support your reasoning.

Just submit a letter for a request to withdraw your petition. You'll have to pay the fee again, and start all over, but it won't hurt your chances next time. They would rather you withdraw and re-apply than waste resources on what you know could be a bad application.

My spanish is horrible but I'll try a translation for you:

Cálmate querida. No va a doler nada de retirar una solicitud y volver a presentarla.

No es necesario, ni la atención por una razón, y si más adelante en el camino, alguien pregunta por qué te retiraste petición, se limitan a afirmar que se trataba de un error de papeleo, y explicar la situación, mantener los archivos originales de la primera petición para que pueda aportar pruebas para apoyar su razonamiento.

Simplemente envíe una carta de solicitud de retirar su petición. Vas a tener que pagar la cuota de nuevo y empezar todo otra vez, pero no va a perjudicar sus posibilidades la próxima vez. Ellos prefieren que retirarse y volver a aplicar los recursos de los residuos en lo que sabes podría ser una mala aplicación.
