My very odd I751 story

I wanted to share my I751 story here, in hopes it may be helpful to someone. I have spent the last couple of months Googling like crazy for other people's experiences but came up with very little info on my particular situation.

So here it is...

I originally received my conditional GC back in march of 2006. So about 90 days before my 2 year anniversary, I filed my ROC, I751.

I soon received a biometrics appointment, and after that, nothing.... Called the info line, made info pass appointments, etc. Was told to be patient and wait. Meanwhile, it was April of 2012, and my 1 yr extension was up! Soon after, I received a notice that said my petition was considered abandoned due to not enough evidence. Apparently they had sent an RFE, which I never received.

I did not have the money to start over....

Fastforward to March 23rd, 2013. I sent off another ROC packet. YES I WAS 7 YEARS LATE at this point.... Anyways, included tons of evidence, a nice coverletter and a check. On March 28th I received my NOA, on April 2nd I received my biometrics appointment which was scheduled for the 17th. About a week after that, I started trying to check the case status online. No luck, since I later found out I was using the wrong number, off my first NOA... :)

I got impatient so on May 20th I decided to call the infoline and ask for an update. The lady told me CSV was currently working on Aug. 2012 petitions, it would be at least 6 months before they would even look at mine. Which I kinda expected anyways, but hey, doesn't hurt to ask right.

On May 24th, my ROC was APPROVED! I am still in shock.... Didn't even get an interview :)

So, for everyone out there with a late filing.... Don't give up. It can and DOES happen :)

That is interesting, did you provide an explanation about why the I-751 was seven years late? Maybe they acknowledged that you had filed within the 2 year period...

I assume you did not travel outside the US since 2008? I think that is main issue with getting the 10 year card. Although I am curious what would happen if you had travelled and tried to get back into the country.

Thanks. I did include an explanation, in the cover letter i described what had happened, and I apologized for filing late.

I haven't traveled outside the country since 2008, im very excited about being able to travel again!

Timeline

Couple of questions/curiousities:

  1. You initially got GC in 2006, 2 year is over in 2008. Your extension is valid in 2009. How was your extension up in April of 2012?
  2. Rather than filing another i-751 which cost another set of application fees, wouldn't it be nicer to push them harder to inquire to your initial application? It was not your fault that they did not adjudicate your case.
  3. Wasn't it wise to file directly the N-400, application for naturalization? rather than filing another i-751. You were eligible to file for naturalization in 2009, considering you were still married to you USC spouse. If you were divorced, you were eligible in 2011. In this case USCIS would not ask for valid GC because you filed for renewal/removal of conditions and its not your fault that they did not decide on your case.

Anyway, I'm happy for you. I know the feeling of being able to go back home and travel AGAIN!

Your case inspires a lot of people who are scared of immigration chaos.

Oops, my bad. That should have said 2010 my extension ran out, good catch!

I tried to get them to figure it out, but according to them, it was all my fault and I was advised to file a new petition. So I did. Looking back now, I probably could have done it differently, but it worked out either way!

I didn't really know until recently that I could file for N400 before I751 was approved. I have learned a lot since I started reading here!

But even if I did know, I probably would have stayed a resident, so that my kids can get dual citizenship :)

Sunnyboy, it was a joint petition, I am still married!
