It has just happened 4 hours ago when I found out the news... Story is that my husband work in the USA in two separate occasions with is tourist visa: 1 month in 2009 and 3 months in 2010.On March 2011 he was coming to visit me (two way ticket) to get engaged when he was detained in Houston airport and interrogated. Anyhow we got married in El Salvador (I know my husband from when we were going to High School together it has been 25 years, we lost touch and found each other on FB).We decide to marry, we are so happy together and soul mates we are in contact ALL the time through Skype, Facetime, and bunch of other apps. The I-130 was submitted and approved, NVC completed, and my husband's interview in El Salvador was requested for him to file I-212. So we did, now is denied....(feels like the whole universe when crushing down), I am shock and don't know what to do or where to start. The letter written by this person is mean, he states that is a shun marriage (this accusation really hurts my heart has I love my husband so much, I was personally interviewed by an officer for the I-130 an approved), and also he has disobeyed the rules twice because of working illegally. He has no criminal history. I thought this waiver was to demonstrate the USC hardship and not to denigrate their own civilians. Anyway, I have read that appealing the waiver costs $630, can take up to 18 months, and it is very unlikely anything will change. I guess the other option is to resubmit waivers (this time i-212 and i-601) as this officer said that the i-601 was necessary too. Or just pack up my stuff to go be with my husband so we can actually support each other and I miss him with all my being..., the part that hurts is that I would have to leave my daughter behind in the USA as El Salvador is not stable and safe.

Tomorrow I have gotten a Infopass in my local state to see if there is any other options, anything that they can tell me, and to (if I can complain of the untrue accusations made about my marriage. Just not fair, my husband and I are dedicated to our marriage no matter what. It is just sad it comes down to this. I know from the beginning there was this risk but I was not counting with the way this people treat, accuse, and ends it as were there is nothing else you can do. Just venting and see if there is a kind person(s) who can provide me with any other options, thoughts, or better ideas... Thank you so much for your time and response(s) before hand. I think at this stage it's time to call a lawyer to help. Hopefully they can get creative and find a way you can resolve all of this.

So sorry to hear such a tough situation. Keep the hope that there will be a solution.

I'm so sorry to hear your news. Never give up! Get right back up and keep fighting. Try again and i agree with the previous response. Consult with a lawyer and explore your options. Did you prepare your own waiver?

Was your husband working using his name?

My husband has a similar story to yours but he still hasn't had his interview yet. Now i'm nervous after hearing your story.

I did go to my local USCIS office today and was not any help at all, it was to be expected. Seems each office is a different world which they lack communication. I have contacted a lawyer and I am just waiting to see what she thinks and what are the options.

Michell, I did prepare my waiver with lots of research and also because I thought that not having any criminal record it would be easy. But they took it as everything I said they turned it around and used it against me with also comments of not giving enough explanation. I hope the best for you Michell... and yes, get a lawyer (I learned the hard way). I thought that being forthcoming and sincere would count but unfortunately it does not work that way. I already have a lawyer. We just haven't reach the waiver stage yet so will see how it goes.

First of all sorry to hear that you got denied.

Second do not take any of this advice personally but follow it;

1. Regardless of the research you did you clearly did not "get it" evidenced by the fact you did not file the I601 and I212 simultaneously. They rarely approve a stand alone 212.
2. You have a lawyer but you don't need "a lawyer" , you need a brilliant friggin lawyer with a track record of approved I601's regardless of the price.

3. Don't do anymore of this yourself. This is a legal proceeding you are not an attorney and even if you were a doctor you would not do your own brain surgery, something

that could effect you for the rest of your life.

4.On a personal note, I know you love this person but do not leave your child in the US to go live with this man. You and the child will be forever damaged.

You say you went to HS together, was that in ElSal, or the US?

He worked in the US? How did he work? Did he complete an I-9?
