Im an F1 student marrying a US citizen who is also going to be my sponsor. So my fiancé has just started working recently as an independent contractor. He will be filing taxes this year, but he hasn't been filing any taxes since 2001 because he was unemployed. He was helping out his mom with family business, so she was taking care of all his expenses during the time. This year he will be filing his taxes since he is employed now, but since we are applying for AOS right after we get married at the end of this month, he can't submit any copies of Federal Income Tax Return for the recent years since he was unemployed. Should he just write a statement about his situation explaining why he can't provied FITR and include ithe statement with the I-864 form? Can it cause any problems with his as a sponsor? He can prove his current annual income.

He is making $26,000 a year and I also get financial help from my dad who lives overseas. (He's been helping me out and will continue until I am eligible to work, so it's a steady income for me). Together with my money, our joint income is around $40,000 a year, which meets the requirements. Do I need to send some kind of proof that my dad has been transferring me money all this time? (I have all the bank transactions). And is it even okay to include my source of income?

Sorry if I sound confusing, but I would really appreciate your help. Thank you all so much in advance.

Self-employed people need tax returns to prove their income, and an allowance from dad abroad won't count.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

But he just started working couple of months ago, so he didn't have a chance to file his taxes yet. His mom won't co-sponsor, we don't have any other joint sponsors.
So the fact that I get a financial support from my dad shouldn't even be included?

You can include it, but what you are talking about is basically pocket money, on a higher scale. Not only is it uncertain, it also comes from a source outside the USA- I haven;t seen such accepted by USCIS before. What I would suggest is either cats your net wider for a co-sponsor (neighbours, church family, friends from college, old highschool friends, distant cousins...), or continue on your student visa and file AOS after he has had a year's tax filings. 2 months of freelance/ self employed income really doesn;t show the reliable pattern they want to see.

Technically,if I don't include my dad's money, my fiance's annual income is enough for us to be above the Poverty Guidelines for our household, so the only issue is his Federal Income Tax Return, which he doesn't have because he was neither employed nor was he making enough money at the time to file any taxes. Unfortunately we don't have anyone close enough who we can trust to become a co-sponsor.

I am lost a little now..thank you so much for your answers though.
