I was wondering what that post meant, seemed to say one thing and then come to a contradictory conclusion.

There is one case.... the appeal was done in April of 2012 I believe....

take a look at one of my other posts about AAO... gives a link to the AAO and the appeals/ and denials and why. A man form Africa had not seen his fiance in like 26 months.

The 2 year rul - SOLID no room for even a DAY out of the range!

I sent my I129F a couple of weeks before our 2 year mark is up. Haven't heard anything but the Alien Registration Number change. I certainly hope to get approved, not denied. But when I posted a topic, a lot people's response were that I'd be fine, since I filed before our 2 years was up. We still haven't seen each other though, it's very hard.

On October 2013, our I-129F Refused under 221(g)

So our son and I went back home to the PHL..

Hi there,,

Yes, we personaly met about 2 and half years before we filed .We were approved after filling the hardship waiver for the required 2 year meeting in person.. I explained my reasons on why i could not go and backed up with evidences ..honestly i was expecting a denial as it is very diffcult for them to waive that requirment and my case was a miracle thanks to Allah for it....

yeah, we got approved too. i sent the application 2 years and one month out of the last time we met. There was an RFE for 2 years requirement. i wrote them a letter with all evidences to support our hardship and the ticket already book to go to see my wife again prior to the RFE. we got approved 2 weeks later. everything else went smoothly after that.

Interesting... that is, I think, 4 VJ cases now where hardship was approved when the meeting requirement was missed by only a short time.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I got approved whithout the 2 years requirement, because I am an asylee, I could not return to meet my fiancee. I have been in the US since 2009, and my fiancee and I have a baby girl, born in 2009.

the case is right now t the embassy, we are waiting for the interview. I am also in the military. hope it helps.

Interesting/weird update.

We received an RFE a couple of weeks ago (my fiancee's family has been helping her move so we haven't read it yet, presumably it's asking for proof of having met within the two-year period).

We assumed this meant it was time to withdraw and re-file, but then I got another notification; that they had received and processed our response to the RFE yesterday, despite us never having sent anything.

What gives?

I saw that thread about Jordan and could not help but think a mistake was made that may well be corrected.

Also there are so many issues with that case I could not help but think there will be a very long road ahead.

I just wanted to post an update (I thought I had last year, but possibly I was so butthurt about the outcome that I let it slide.)

We withdrew the application, waited for them to confirm receipt of the withdrawal, then sent off a second application package, changed to reflect the recent meeting and the fact that we had applied before and withdrawn the application.

The latest I129F was received by them in mid October 2013.

I have just opened an approved NOA2 today; June 16 2014.

All's well that ends well, but I wanted to update for the benefit of others.
