Hi!

Does anyone know how long I have to change my name after marriage (I'm the USC, female)? Is there a law stating a time frame?

We are having a ceremony in France next September and I want to wait until after that. I also haven't decided what name to take - I want to hyphenate with mine but he has a hyphenated name!

You are not obligated to change your name and as far as I know you do not have a time frame to follow. I will say that once you change your name on one document you need to make sure and change all documents. When I changed my name I waited until we had completed thur the NVC processing on our CR1. I did not have any problems and be aware that if you change any documents you need to update the passport as well if you plan on traveling. Good luck on your upcoming marriage.

You never have to change it if you don't want to change it. SSA requires more evidence if you wait more than 2 years. Now if you don't change it you will need to continue to work and file taxes with the premarriage name and probably will not be able to able to change your name on you driver's license, since most states now check the DL application info against the SSN record.

How can I make sure that the employee's SSN and name given to me are correct?

You should ask to see the SSN card, although the employee is not required to show the card unless it is readily available. You should record the name and SSN shown on the card in your business' personnel and payroll records that will be used to prepare W-2 reports.

If the employee indicates he or she prefers to use a different name for employment purposes, advise the employee that you must use the name as it currently appears on the card. Also advise the employee to request an updated Social Security card with a name change and to show it to you so that you can update your records and so that your records and the Social Security records will agree.

oops!

Left some info out. We are already married in the US. We can have the French gov recognize the marriage but we prefer to have a legal ceremony over there as well for his whole family (40+ cousins and all the aunts and uncles to go along with them!) to be present.

So I am wondering if I can change my name here after the September overseas wedding which would be a year after the US wedding. Note: we are not moving to France.....yet!

Just be sure and buy your tickets in the name on the passport - the airlines are pretty strict about that - (they match the name on the ticket to the ID for domestic travel). Good Luck

Well if you are already married and intend to change your name what are you waiting for? Go to an SSA office with your documents

If you read my post you would see I am waiting for our France wedding! So how about an answer to my question - how long do I have? Oh, I take it you don't know. Then don't bother posting!!!!!!!!

Just be sure and buy your tickets in the name on the passport - the airlines are pretty strict about that - (they match the name on the ticket to the ID for domestic travel). Good Luck

Thanks Motu. Yeah, that's one of the reason's we don't want to change it yet. I still need to be "maiden" for the France wedding.

How can you get legally married twice???? you are legally married and the french government will acknowledge it if you register it.... surely all you are doing is having a blessing in France... you can not go with your maiden name and pretend not to be married....

As for how long you have to change your name... as long as you have evidence to prove your are entitled to change your name because of marriage then you can do it when you want... There is no logical reason to wait to change your name as you are already married... The name on your Passport etc... will not effect you having a blessing in France... unless of course you are hiding the fact you are already married or some other reason...

I haven't changed my name yet, mainly because I don't feel like sending in my marriage certificate to all these places to change it. I do change it when I get something new (like a bank account), but seeing as I don't have a SSN yet, and can't get a driver's license, i am in no rush.

Yes, I know the French gov will recognize it if we register. But we want to have a ceremony over there for his family (read earlier post), which will be legal, not just a blessing. We can go either way, depending on what we want. Sooooo we want to have ceremonies in both countries.

And there is a logical reason for not changing my name yet. I don't know which name to have so it would be illogical to change it pre-decision.

FYI... it is illegal to sign a marriage license stating you are free to marry when you are not... even when you want to marry the same person.... this is why so many on VJ go home to their own country after getting married and have a blessing.... especially when your home country recognizes the marriage that was done here in the USA...

Apparently you haven't seen the movie Airplane. If you had you would understand my reference to "surely". Apologies in you felt I was insulting you.

I posted a simple question and received this response from you:

What are you implying? Now that is rude and insulting!

Also, in your PM to me, you state we are all here for the same reason. Of course! And to assume I get angry is wrong. That is your preception. And saying I am rude? Look at yourself! To presume I don't have a logical reason to not change my name yet? To imply there is something else going on? Why would I not respond to that? I was asking a simple question, in hopes soemone knew the answer, which of course I will confirm with the necessary authorities. What I did not ask for was judgement and in my view, that's what you gave me!

I wish you a plesant journey as well. And if you haven't seen Airplane, check it out. It's dated but still worth the watch, surely!

To tell people to not bother posting is rude.... you post your question on a public forum then you will get comments about your question.... I was trying to understand how you could get legally married twice without getting a divorce first.... when you change your name if you do is up to you.... but I was trying to understand the 2 legal weddings.... you see when you file for a marriage license you declare that you are free to marry if you already are married and your government recognizes that marriage then you are not free to marry are you..... so that led me to ask if there is some other reason you do not wish to have any documentation in your married name.... but as I have said it is up to you when and if you change your name....

To use a quote from a film that could be take as an insult/angry response is not a good idea unless you know that the person you and replying to has see the film...
