hello everyone! hope you help me with some of my questions:

1. would still be ok if we apply for AOS with my I-94 expiring on july 8, 2013 (and my visa expiring on july 17)?

2. did i get it right that my application for EAD and AP being free of charge if i send it with AOS application? so we should just basically pay $1070?

3. can we send it online or just strictly by mail?

1. Yes. The K-1 visa will become null and void once you use it to enter the US. You status in the US is based on the I-94.

2. Yes.

3. You must mail it. Follow the directions in the I-485 instructions.

can i apply for just EAD and AP though? i want to save with my own on the AOS stuff (it costs too much, i dont want to burden my wife with it, we already married last april 18)....but the problem is my I-94 expires on july 8 and from what i heard was K1 cannot extend their I-94s. :(

is there a way around it? where i can apply for AOS next year? (after i save up, my medical expires on august 2014 anyway) and just apply for the EAD and AP in the meantime?

From what I understand, your I94 CANNOT be extended. You have to apply for AOS as son as you can before it expires, or your betrothed will be out of status. Unless someone can shed some light on things I don't know about...

There is no time limit within which you need to file AOS , they just can not legally work and will not be allowed back onto the US if they leave

so can my AOS wait until i saved up for it when i get a job in US?....my expired I-94 wont be a problem as long as we got married before it expired and as long as i applied for EAD (and AP) as well right?

You cannot apply for the EAD and AP without filing the I-485 to adjust status. Technically an EAD can be applied for using the I-94, but it will expire when the I-94 does, and would not be processed in time to even use, so that is a huge waste of $380. AP cannot be applied for ahead of the AOS. EAD and AP are free when filed with a pending I-485. You can wait until you have the $1070, but you cannot work or travel outside the US and re-enter and you will be out of status and accruing overstay. The sooner you file, the better.

File all now and be done with it. It's much simpler to do all three now. You won't regret it.

January 15, 2012 met on line

April 18, 2012 met in person in Cebu

April 20, 2012 proposed

May 28, 2012 filed K1

June 6, 2012 received email K1 accepted.

August 28, 2012 NOA2 approved!!!!!!!

September 21, 2012 went back for vist number 2

Had a wonderful time!

Flying out November 3 to be together

November 14, 2013 picked up visa!

November 29, 2013 arrived in Anchorage

November 30, 2013 applied for marriage license

December 15, 2013 civil wedding

February 23, 2013 NOA 1 reviewed

April 4, 2013 Biometric appointment

May 9, 2013 AOS intervie

May 9, 2013 Approved ap, ead and green card

May 18, 2013 received Green Card, EAD and AP in mail

Your K-1 medical, if vaccination requirements complete, has to be less than 1 year old at the time you send your AOS paperwork, in order to still be valid.

- Aug 31st, 2011 - Mailed I-129F package - May 29th, 2012 - Mailed AOS/EAD/AP package

- Apr 13th, 2012 - Visa received - Aug 24th, 2012 - Green Card received

- Dec 29th, 2021 - Filed online. Got notice that biometrics will be reused.
