We receive our first NOA on March 12th after my wife sent off the i-130. Neither of us have heard anything since and we are starting to get worried as a lot of the timelines on visa journey where the situation is similar to ours received NOA 2 after 2 months or sooner. Should we be getting worried or is this normal and is there any way we can find out what is happening?

Our timelines are very similar. I sent mine on 5th of March 2013 and NOA1 dated 8th of March. Most people who has similar timelines are either DCF or just very lucky. I would wait for a month or two before I start worrying about it.

You can always talk to Tier 2 and find out where your application is located. Mine is in Missouri Service center and they said it is in backlog.

I understand your worries; it's true that some people with your priority date have received NOA2. You can call the 1-800-375-5283 select the change of address option and from there I think you will be able to talk to someone. Tell the person you talk to that you would like to talk to a tier 2 about your case. Hopefully you get a positive news.

worrying is the worst thing you can do

if you are really interested.. call uscis, get an IO and ask if your file is still at nbc or if it has been dispatched to your local office

if it is at the local office, you can go check on the status with an infopass

nbc does retain and process some petitions

sit back and relax

don't start worrying until you are past your 5 month mark

good news is that uscis is catching up on the backlog, although the backlog didn't pertain much to 130's

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

oh no a tier 2 wont tell you that I have been reading vj for over a year and with my change from a 129 to a 130, I have been watching the challenges and changes that have evolved since DACA started and screwed up the whole process

find out where your file is and go visit it, that will at least put your mind at ease

I am a march 7 filer, I called USCIS, they said it is still not transferred anywhere and they where not ready to give any other info...So just waiting to see what happens.

Hi there,

December filer here, my NOA1 is dated 19th Dec 2012, in two weeks passing the 6months mark.

Yesterday called USCIS, they said the case is still at NBC in the backlog and it will take at least 50 more days to look at it as they are currently processing Oct 2nd !!

What a joke! Asked what about their "5months goal thing" they were keeping telling about everytime I called. Tier 2 responded it is still within "normal" processing time.

Great! When you pass 5months mark the famous 5 months goal becomes 8 months goal, perfectly normal.

Whoever got transferred to the local office got lucky.

Other December filers you see approved faster because they filed DCF, their application was sent to the local field offices that do not have a huge backlog and process faster or just got lucky. Mine I-130 is still at NBC and most probably will not be send off to local office until the NBC feels they are "overwhelmed" with processing. This is what the Tier 2 said.

in Jan it had 2500 awaiting applications with processing speed of 350/month that gives you 7months, instead of that they decided to keep it at NBC for 8months or more. Now the whole CR1 process will take a year if there there is no AP involved. Great job NBC!
