I was applying for K1 but had evolution of my relationship in the cover letter.

Thank you for your input san diego! I think we will write it on a separate sheet, but we will definitely add the evolution of the relationship.

So many filing the I-130 don't think about telling their evolution of a relationship. I say why not. Why would anyone want somne stranger to fill in the gray areas with their own thoughtssleepy.gif

You should disclose all the details of your relationship. Your overstay will be forgiven, for you are now married to a US citizen.

In dealings with immigration, honesty is always the best option.

Clarification on this - overstays are not automatically forgiven because you are married to a US citizen. If they were, many people would not need to file waivers for overstays (I-601s). The penalty of an overstay depends on the length of period you were in the country without permission.

Regarding the letter, it can't hurt. If you require a waiver following the visa interview, it will also be beneficial.

It is a 10 year ban, Argentina has not been a VWP country since 2002.

My wife and I had similar circumstances in our journey. We knew each other years ago while she was in the US, I found her again years later and she was home in Colombia. Overstay needed an I-601 waiver. I included an evolution of relationship letter with the petition. Can't say for certain whether it helped or hurt. We got kinda Stoked at my wife's interview in Bogota, but we made it through ok.

I'm pretty much aware of the 10 year ban, unfortunately. Thank you.

And I live in Argentina but I also have spanish citizenship, so I have the passport of Spain. That's the one that I used to enter the USA.

You are not alone, try to do your best and use every document to help you in your case. Just be honest at the time of your interview. Some people get their visa after overstaying , depends how long, depends on every one's situation. The hardship letter is not impossible in your case but you can not know that before your interview at the embassy.
