I am currently unemployed , but I have an arbitration hearing on June 26th . I have been waiting for 9 months now for that hearing . I have been on railroad unemployment for those past 9 months . My case looks good to get the job back and back pay . I will have to wait for 30 days for an answer . If things should work out to my favor . I might not be back to work until about August or September . If our NA02 should arrive during that time will a letter from the job be enough ? I could show pay stubs , but they would be from 2012 . Could I show the records from my unemployment instead along with the letter of reinstatement ? I do not want to use a co sponsor if I do not have to . I do have W2's and Tax Returns going back for 2010-2012 . All those years show an earning well over the poverty line .

Another problem is that I have previously filed an affidavit of support for my ex-wife and her 2 children . My ex-wife is now a citizen and I know longer have to claim her on the new support . Her son is 15 and I think he is filing under his mother now to become a citizen . Her daughter is over 18 , so I need to at least add her to the support ? Who can I call about this to check on that ? To see who needs to be added or not . This is adding much confusion to filling out the I-134 this time . Talking to my ex-wife is not an option to find any answers . I want to fill out the I-134 with no problems and to have the household size correct . They do not live with me anymore though . They are still in the household even while living apart ?

If I get my job back this all goes away ! Pray for me :)

Keep in mind you do not have to schedule her interview right away even if you receive NOA2 today. We received our NOA2 Dec 31st and I did not schedule her interview until Feb 6th. I believe I had yet another month or 2 by their rules to schedule her. Therefore wait until you know you are earning enough so you do not get a denial. It will be nerve racking for you if you send her in with hopes and promises letters. Being unemployed is just that, unemployed so this is the income they will consider with you supporting her.

As for your ex. If she is a USC then you now are no longer obligated financially for her. She passed her USC test and requirements without you so she is now as equal as you and I.

Would I have to include my daughter in the I134 on Question 8 ? The following people are dependent on me . She does not live with me , but I pay child support for her . I am guessing that I include her in that question with partially supported ? She would not be included in the household though ?

I filed an I134 for my wife and children back in 2009 and 2010 . My ex-wife is now a US citizen and I think her son is as well . He was 15 when his mother became a citizen . Does he become a citizen when his mother did ? The daughter how ever was 18 when she came over . I am still responsible for her right ? How do I add them to the current I134 ? Does she become a member of the household even though she no longer lives with me ?

What do you put in the box that explains the alien liability and food stamp act then has space you can type . Your printed name ?

I filed for a federal extension for 2012 giving me until Oct 15th to file my taxes . How do i handle this on the I-134 ? I did my taxes online , but filed for the extension . I was able to get a printout for the year of 2012 , but not filed . I am in the process of settling with the IRS . If this is not completed before the interview should I include the copy of what I was able to print ? I am going to include 2010 and 2011 taxes that are completed . Of course along with W2's bank statements ect....

I have been out of work for 9 months and getting my job back on June 26th . Without going into detail this is why my taxes are still on going with the IRS . I will not be back to work until August . I am worried that they will see the gap in 2012 . I would on paper still meet the requirements . I am worried about 2012 and thinking if I should still include a co sponsor . Even in 2012 I made above the poverty line for the months that I did work . Being unemployed for part of 2012 is the concern that I have .

Thanks for any help or advise
