I entered on a tourist visa (or at least I think) but I told them my reasoning for coming here was because I wanted to live here so they allowed me to stay for only 2 years. I tried to renew my visa after 2 years so I could stay longer but I wasn't able to. I decided to stay, so I overstayed my visit. (wrong choice I understand) But then I met my husband a few years later and thought I would be spending the rest of my life with him. Things didn't work out after my miscarriage and he never filed for me to get any kind of GC. I was foolish to not do my research during our marriage. I have been crying for the past few months trying to figure out what I can possibly do. Should I just get a lawyer would they even be able to help me? Or am I hopless?

Yep, it doesn't sound like she qualifies for VAWA.

And the OP keeps calling herself a "good citizen", she may have bigger problems. She's not a US citizen, not even a legal resident. It's very important to be articulate when it comes to language like this. If she ever claimed to be a US citizen, she's done.

Not to mention that her path to legal residency is already looking tough.

having a 2yrs visa doesn't mean u can stay here for 2 yrs continuously. and i don't think the immigration would grant u 2yrs to stay continuously been a b1 or b2 . i think they usually give 6months, this is just a correction to what u said above

Sorry to hear this but dont give up yet, maybe if you hire a good lawyer things would work out for you.

Actually if she's calling herself a good citizen, she isn't aware of the mistakes she's making. Doing so can lead to all types of problems for her.

If I had to guess, I'd guess she got a multiple entry visitors visa, and assumed since it was valid for two years, she assumed she could just stay for two years.

Where is your passport at where you were stamped when you entered? You should have that i pray.

And like the previous person said yes you may have gotten a 2 year Visa but you can't stay for 2 years. It's usually 90 days to 6 months. That stamp in passport tells you how long CBP gave you.

Because you came here on your own and no one brought you (work or K1 or CR1/IR1) you have no foot to stand on. Can't adjust.

Outside of marriage it will be hard to stay or enter. Sorry

If he won't do the paperwork then no, you cannot stay.

Also, you are NOT a "good citizen". You're NOT a citizen. You're an illegal alien residing in the US. Sure, you're paying taxes while working illegally, but that doesn't help you get status.

You need to find out what visa you entered on. Your comment about 2 years isn't normal.

there is no way they gave you a social security number that authorizes work. you are either using a fake number or have a card not authorized for work. you are misrepresenting your situation, and you know it.

It is so disgusting that so many supposedly "good" immigrants immediately jump to the VAWA answer to someone that has arrived in the US under less that clean methods and then has failed at getting a green card. VAWA has it's place but it isn't the easy cure to illegal immigration and when used like that it is actually abusive to the USC. Suggesting VAWA in cases where it doesn't apply is coaching someone to commit immigration fraud which is a TOS violation.


This will not be over quickly. You will not enjoy this.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Is ther anything I can do in order to stay here in the U.S.? I am so heartbroken I have built a great life here made wonderful friends and best friends and have made family here
