I 751 form 2 children filing separately

Hi this is a simple question i am sure many of you know about.

My wife entered the US 2 years ago, March of 2011. She has 2 kids from a previous relationship. The kids stayed with their grandparents while my wife spent time here adjusting to life in the U.S. We then got the kids in August of 2011. We are all now living happy and healthy and my wife and kids are fully acclamated to life here in the US.

We filed form I751 form to remove the conditions on my wife's visa back in December within the 90 day window. She has not received her 10 year green card as i know these things take at 6 months or longer to process.

Now we have to file for the kids since they came separately. The I751 somewhat confusing in regards to how it needs to be filled out regarding children.

The kids are ages 7 and 10. Here are my questions:

Do i need to fill out 2 separate I751 forms for each child? Do i pay the 500 plus dollar fee for each child?

any assistance is much appreciated.

September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

it might help to read a piece of information on the uscis site that speaks to being ale to add them to your wife petition if they came within 6 of your wife. Updated date on it is more current then the info on the site that refers to 90 days.

'Conditional Residence and Removing Conditions

If you are petitioning for a step-child and have not been married to the child’s biological parent for 2 years at the time the child receives permanent residence, the child will be granted conditional permanent resident (CPR) status. Form I-751, Petition to Remove the Conditions on Residence is used to remove the conditional basis of permanent residence. (Note that Form I-90, Application to Replace Permanent Resident Card is NOT used for this purpose.)

If your spouse and child became CPRs at the same time or within 6 months, the child can be included in your spouse’s petition. If the child became a permanent resident more than 6 months after your spouse, or the child was granted CPR status independently of your spouse, the child will need to file a separate Form I-751.

Form I-751 must be filed within the 90-day period prior to the expiration date on the conditional resident card. If you fail to file during this time, your spouse and/or your child’s status will be terminated and they may be subject to removal from the United States. Basically the same question. Our son arrived just over 1 year after my wife. Wife now has 10 year GC, but I will need to apply for son soon. Any guidance? Due to repeated difficulties, RFE's etc. with wife's process, how do I ensure prompt approval for son?

You need just one application for both the kids and fee would be 675 (590 application fee plus biometric fee of first kid + 85 biometric fee of second kid). The application should be signed by both the parents. Start filling the form and if you have any specific question regarding any item, then get back. Check the links given below for help. My wife and her son came together but get their Green card 1 year apart, during my wife interview immigration officer told us that we file the removal of condition at the same time so we did, we received a letter of denial for her son after we file saying we need to file seperately due to different expiration date of their G/C and now we are about to put together his I-751, My wife is 10 year G/C holder.

My questions are:

1. What kind of evidence do we need to provide? Is it the same evidence as the mom, he is 7 years old.

2. Who sign the forms (I-751)

3. All the evidence was sent to USCIS (school records, teacher letter etc) but get turned down and

never get them back.

Anyone file seperately? Your help is greatly appreciated.

1. Yes, the same evidence.

2. Both parents to sign.

3. You were supposed to send copies and not original. If you sent original, then you will have to get those records again and send just copies.

Forgive my ignorance, but how can the "evidence" needed be "the same"? For my wife, it was proof of marriage, bank records, utilities, joint taxes, joint credit cards, etc. My son has NONE of these.

Realistically, has anyone any guidance on what to include for this for one child, separate from the parents filing?

Yes, it is not logical but that is what USCIS has been asking in addition to child related information - may be because they are dependent on the immigrant parent to start with. Why don't you call USCIS and ask!

I did triedt o call USCIS all day today but its hard to get hold to a live person, agree with Roger my stepson has no bank account nor included in our bills so i'm just going to send all his school records showing both parents are involved his daily homework (with our signature), dental, medical appointments, doctor, dental and teacher notes including friends statements will be included.

I am hopefull someone will come forward and share their expeiences before we send his documents.
