Legally Separated but living in same household

Hello, all!

I am a Natural Born US Citizen and my wife is from New Zealand (her name is Amiria), applying for citizenship. We have been married for a little over two years now and have recently applied for the removal of conditions on her i-751. We do have a two year old child together and another one on the way (due October 19th).

I have a few questions:

- We are both legally separated but living in the same household

- We are still madly and deeply in love and are intimate.

- She pursued this last summer when she found out that I wasn't truthful about my ex-wife (My ex-wife is serving two consecutive 10 year sentences and will be eligible for parole in 2018). She knew about the ex-wife but not the circumstances of the divorce or what had happened. And the reason why is because I didn't want anyone to know what a scumbag she is.

Because of this, she decided to file for legal separation based on trust issues until we work things out. It was filed in Vermont and we are now living in Rhode Island. The ex-wife is in the Oregon State Penitentiary.

Amiria and I are still madly in love and I am really pushing her to remove this legal separation.

We filed for separation in October of 2012 and filed the documentation in February 2013. On the documentation, we said we were married and the same was done with our 2012 joint return (which was submitted as proof)

My questions are:

- Will this affect our I-751 to remove the conditions?

- Will USCIS search the court records and see this?

- What can I do in this case?
