I received my approval today!!!!! Finally, I am so happy, I finally have hope again to have my wife and kids in the us for school next August, now here's to hoping for a quick process in NVC

since I requested an exdepite process on 4/2/14, I received a common answer that indicates "You are pending on background check."

So I called today, and Tier1 officer requested another expedite process request.

He said "you are eligible to request another because you do not received a decision within 60 days"

However, Tier 1 cannot be created due to less than 30days.

Now I am waiting for a call back from tier 2.

Geeeeeeeeeeeeeeeeeeez!!!!

MY PD is 6/25/13 and transferred to TSC on 12/30/13....

What's FOIA?

my pd is 06/03/2013, and CSC then transfered to local office (houston),

i went to infopass today driving about 30 min from my office then wait another 30min, finally talked to uscis officer(i guess) then just said that it is pending!! i konw it is damn pending!!!!!

then i asked what is the reason for this long pending then she said it is ready to review and desicion then just said thank you!!!!!!!!! i was not even finished !!!! it took about 3-4min

i just wasted my time and felt like got punched from them.... how rude and look like they dont really care about us..... or they dont konw anything about our case!!!!!

no hope at all now!!!!!!

then i asked what is the reason for this long pending then she said it is ready to review and desicion then just said thank you!!!!!!!!! i was not even finished !!!! it took about 3-4min

i just wasted my time and felt like got punched from them.... how rude and look like they dont really care about us..... or they dont konw anything about our case!!!!!

no hope at all now!!!!!!

I made an appt for the free consultation with immigration lawyer in D.C.

I hope that American Immigrantion Lawyer Association might give me some help regarding this shitty situation.

I will leave a feedback after my meeting time on Friday.

They say that but doesn't mean it will take a year or even a week. It also states the same thing on the USCIS site so don't think it's true it will take a year. They said the same thing to me, it's just a generic answer to get you out of their face. Not nice but that is what they do.

No they don't care and I'm sure they hire people that no one else would hire under any circumstances. They are the meanest, rudest people on earth and there is no reason to be.

Guys I was wondering does anyone know on what condition do they deny 130 petetion? I m getting paranoid now and trying to prepare myself for the worst.

300 days completed since no1 still nothing...never know when this wait will over...getting hopeless day by day the only good news is that my husband is coming at the end of April for 20 days :)

Yup same here it's terrible. 304 days gone. I have lost all positivity and hopes.

Guys I was wondering does anyone know on what condition do they deny 130 petetion? I m getting paranoid now and trying to prepare myself for the worst.

The I-130 can be denied for reasons of ineligibility or "derogatory information," which I think would most often mean a criminal history. If USCIS finds any "derogatory information" they'll issue a notice of intent to deny (NOID) and give you the chance to review/contest their findings. Ineligibility would be stuff like... you're not legally married, or the petitioner isn't a citizen.

Take a look at the Field Adjudicator's Manual for USCIS procedure: http://www.uscis.gov/iframe/ilink/docView/AFM/HTML/AFM/0-0-0-1.html. Section 10.5 is particularly useful for your question.

The wait they're putting you through is absolutely awful, but I'm sure you'll have good news at the end of it. The "something bad" is what you're living through right now! It'll get better, and I hope it does very soon.
