Good morning all,

I'm petitioning a K1 visa for my fiancée. A couple of days ago, I received a RFE, requesting air flight receipts and photocopies from her passport pages (to validate her entries).

At first, I had sent the flight tickets but I failed to highlight the dates, names and origin/destination.

However, in light of what has happened and the possibility of a longer delay (I filed in February of this year). We are thinking about the possibility of getting married in the US (B2 entry) and then immediately applying for ASO, EAD, AP.

We have a number of reasons, apart from the act that we want to be together, she has a soft job offer and knowing that EADs normally take 3 months. I wonder if this alternative route could stir up some problems down the road (mainly at her GC appointment).

I would truly appreciate any help and advise regarding this topic. Thanks

It is visa fraud to enter the US with a tourist visa having the intent to marry and STAY in the US.

The RFE for your K-1 means someone was adjudicating your file. If an RFE was not needed, you would have been approved. Send back the evidence they are asking for to prove meeting, passport stamps, boarding passes, hotel receipts, ATM/debit card/credit card receipts or bank/credit statements showing purchases in each others countries during the times you are claiming to have been together. Back all that evidence up with a few photos taken at the time you were visiting. Flight tickets alone are not enough proof, if that is all you sent.

Once you send back the RFE, you should have your approval shortly after that, 30-60 days or so. Stick with the legal way, the K-1.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
