I-864 question

i called NVC today and talk to one of the operator i asked her if i need to fill out 2 separate i-864 for my wife and my son and she said i only have to fill out for my wife and she will make a note that my son will be exempt because hes only 1 year old and 3 months and im a citizen and my son will not be counted as my house hold size.and the second thing is my parents is living with me so i asked her if i need to include them in the house hold size part.she asked me if i claimed my parent as my independent or do they claimed me as theirs and i said no,and she said i do not need to include them either and my mom have to fill out the i-864a if my income does not meet the requirements.to tell you the truth im confused so if any one whos expert in affidavit of support please help me out im really confused :help::help::help:

Is your son your son or your stepson? More to the point, is he a US citizen.

Read I-864 and answer the questions as asked. The question that asks about people who are related to you and are living in your residence does not include any qualifications about such persons being dependents for tax purposes.

Here is some info on a child born to a USC abroad.

Consular Report of Birth Abroad: A Consular Report of Birth can be prepared only at an American consular office overseas while the child is under the age of 18.

Usually, in order to establish the child’s citizenship under the appropriate provisions of U.S. law, the following documents must be submitted:

application for Consular Report of Birth Abroad of a Citizen of the United States of America (available at the U.S. Embassy)

an official record of the child’s foreign birth

evidence of the parent(s) U.S. citizenship (e.g., certified birth certificate, current U.S. passport, or Certificate of Naturalization or Citizenship

evidence of the parents’ marriage, if applicable

affidavits of parent(s) residence and physical presence in the United States

$65 fee

In certain cases it may be necessary to submit additional documents, including affidavits of paternity and support, divorce decrees from prior marriages, or medical reports of blood compatibility. All evidentiary documents should be originals or certified as true copies of the originals by the registrar of the office wherein each document was issued.

Note: If your child has claim to U.S. citizenship but is born in a foreign country, it is advisable that you apply for a Consular Report of Birth Abroad, especially if you plan to apply for U.S. passport on the child. This Certificate is proof of your child’s U.S. citizenship.
