To whom it may concern :

I am still awaiting the divorce of my fiancee so we she can submit her petition. Since time is of an essence , I am confused and would like to ask for your advices . I have searched through the posts and found conflicting answers and hopefully someone can shed some light on the issue.

1. With K1 visa , you are only allowed to work upon filing of work authorization. The grant of SSN isn't a work authorization by itself . The process time to get work authorization upon arrival at POE is 3-4 months ...Right ?

2. With K3 visa, can you apply work authorization with your application for K3 visa ? which means that upon arrival at POE, you are already allowed to work ???

Thanks and Regards

Filed: Citizen (apr) Country: Ireland
Timeline

1. It's 3-ish months from when you file AOS, which can only happen after you marry.

3. Forget the K3; it is an obsolete visa and usually administratively closed at NVC stage anyways. However, if you are going for the CR-1 spousal visa then you don't need work authorisation, because you get a greencard upon entry to the USA and can work and travel immediately.
