I-129F PETITION FOR FIANCE(E) (Approved)

Hi all,


I just wanted to mention I just received a email notice from USCIS stating that they have approved our I129F PETITION FOR FIANCE(E). We filed back on October 9, 2012. So now it feels like the wheels are finally moving again.

I'm jumping a few steps ahead here but when I get my fiancee stateside then we will have additional steps to make there as well. I was told that there is a step or two that will NOT allow her to travel back to her country until the step(s) have been completed. Can someone tell me what steps these are. We thought about getting married when she arrives plus start some of the steps... but we also want to travel back to her country within a month or two of getting married.

Congrats!

I believe it is the Adjustment of Status (AOS) that you are referring to. After getting married you need to file for AOS and Advance Parole (AP) to travel and might as well her Employment Authorization Document (EAD) so she can work. These all take time. Runs prolly to a MINIMUM of 3 months.

AP is what you want done for her to travel but like I said it takes time.

Congats! She would need an Advance Parole for her to travel, which takes about 90 days (could be shorter in some cases), Apply for an AP and an Employment Authorization Document (EAD) together with your application for Adjustment of Status after you get married.
