Canadian moving to USA NEED INFO

Hi there my fiance and i have been together for about a year and half now and are getting sick of the travel and living apart. I have a few questions. Can i move there get married then apply for k-3 visa while living there. How long will it take for the application to be processed if im living there. Im also thinking i wouldn't be able to come back to canada till everything is processed. If anyone has any better options for me please TELL. Also how long before i can work. Any other forums or info please mention

Check the Guides in the top menu bar to see which is best for you. All the info you need is there. K3 isn't really used anymore. You're looking at either K1 or IR1/CR1.

Timeline

You need to start the process in Canada as a K1 Visa. If you overstay (based on a 3 year rolling average of stays in the US), you may be deported and banned from the US for an indefinite period.

As soon as you get the Visa, you may work once you cross the border. You must then stay in the US until you Adjust Status and receive your Green Card.

I takes about 7 months from start to finish (faster than K3) if you do your application properly and you have no criminal or health issues.

You cannot move to the USA until you have a visa, either the one time use fiancée visa or the cr1 spousal visa. Check the guides to decide which is best for you and your SO. My hubs and I decided on the CR1 and do not regret the decision at all despite not living together for the first year of marriage. Working and being able to travel immediately was important to me and the cr1 provides that.

While both of you can visit no matter which visa you choose, you cannot live together until you obtain the visa. Both require a wait, about the same amount of time. K1 visa interviews are conducted in Vancouver and Montreal while CR1 are only done in Montreal.

BTW ignore the k3 completely. The chances of getting a k3 visa is very small plus its still a one time use visa that requires adjustment of status like the k1 fiancé visa.

You can not work as soon as you cross the border on a K1. You have to wait for your EAD or your Green card. If you obtain a CR1/IR1, you can work.
