I was about to send the petition for our CR-1 last month when my wife told me she is pregnant. I am so confused on what to do now. I have a lot of questions....

Does our baby require a passport to travel?

If passport is required how do I get one for the baby?

I have also read that the baby will be a US citizen when born...How, when and where do I get the right birth certificate?

If I file for CR-1 and Visa is approved how long does she have to travel to the US? I'm afraid she will be approved and not be able to travel with in a certain time frame after giving birth and also time frame for baby to travel etc....

I have read to file for CR-1 and then K-3 and she can come here immediately and give birth to the child here...Is that true?

What paper work do I need to get my wife and newborn child here?

About me....I am a born US citizen serving in the US military for the last 14 years. We have been married for 3 months...the baby is due in November. If you need anymore information please ask me....

I was about to send the petition for our CR-1 last month when my wife told me she is pregnant. I am so confused on what to do now. I have a lot of questions....

1. Does our baby require a passport to travel?

2. If passport is required how do I get one for the baby?

3. I have also read that the baby will be a US citizen when born...How, when and where do I get the right birth certificate?

4. If I file for CR-1 and Visa is approved how long does she have to travel to the US? I'm afraid she will be approved and not be able to travel with in a certain time frame after giving birth and also time frame for baby to travel etc....

5. I have read to file for CR-1 and then K-3 and she can come here immediately and give birth to the child here...Is that true?

6. What paper work do I need to get my wife and newborn child here?

baby is due in November.

1. Yes. A US passport

2. She will need to file for CRBA (consulate report of birth abroad) after the baby is born.

3. See #2. The process is the same across the countries (mostly) so knowing what country she's from would help

4. CR-1 takes about 6+ months to process. She'll have had the baby or be close to it before she gets here. She will need a chest x-ray for her visa medical. She can wear a lead apron or wait until after the birth and do the xray then. Once approved she has 6 months to enter the US. so you have at LEAST 12 months from now until she *must* enter the US... plenty of time to have the baby and process the CRBA.

5. Yes to Cr-1, no to K3, and no to come immediately and give birth here. K3 is now obsolete. It takes the same time as the CR-1 and is superior

6. CR-1 stuff for your wife, CRBA for your child once it's born.

The CRBA stuff timeframe depends on her country. Could take a week to a month. Once she has the American documents and her CR-1 visa she can fly over.

Vanessa & Tony, as always, gave you the best advice.

Sadly, there is no way to get your wife to the US immediatly. So you'll want to make plans to have the baby abroad.

Here is the spousal visa guide for your wife http://www.visajourney.com/content/i130guide1

And the crba for your baby http://travel.state.gov/travel/living/living_5497.html

what country is your wife from?

Good luck
