I have a question!!

I live in the Netherlands and I got engaged on 11-03-2012 to an American citizen. For the holidays i went to America to visit my fiance for a month i traveled with an ESTA. After 5 weeks I went back to America because thats when we wanted to get married. I traveled with an ESTA again, only this time i got questioned and asked me for how long i was going to stay there, the typical stuff. We got married in America, now i am back in the Netherlands. We field for an I-130 on 05-17-2013. Now i want to move to America after this summer, my question is does anyone know how long is going to take before i get a notification of the I-130 and when they approve it or not? And can i travel while I"m pending for the I-130?

I hope someone can help me bc everytime I call the USCIS they tell me different things.

We filed for an I-130 too after we got married. The USCIS notified us on November 29, 2012 that they had received our papers. I went to see my wife and family for the holidays in December 2012.

We are represented by an attorney and he advised me to take some kind of proof with me of the ties I have with the the Netherlands. Immigration just want to make sure that you are returning back. If they aren't sure they may refuse u entry to the US.

So I got a letter from my employer stating I was allowed to go on a holiday to the US for a certain period. I also made a copy of the lease contract for my appartement. I took those two documents with me on my trip to the US, just in case.

When I arrived at the airport only two questions were asked:

- What is the purpose of your stay? (I told the truth)

​- When are you returning? (I of course told the truth)

That was all smile.png So don't worry you can go back to see him while the I-130 is pending.

I don't remember exactly when our attorney sent our papers to the USCIS but I think it was a couple of weeks or maybe a month before we received the notice from the USCIS on November 19, 2012.

The I-130 was approved on January 8, 2013.

When you have received a case number from the USCIS you can check the status of your case on

www.uscis.gov

It's very stressful, because i wanted to start college in America this September but i guess that's not going to happen.

Did you receive anything from the NVC? And when are you planning to move to America?

Aha ok, i don't understand this. If I can go to America while I'm waiting for the notification of the I-130 why can't i just stay there? Is that illegal?

Yes, it's illegal to immigrate to the U.S. unless you have an immigrant visa. You will not have an immigrant visa until the I-130 petition is approved, and then your local U.S. Embassy approves your application for a visa and stamps it in your passport.

You are able to travel to the U.S. using ESTA even while your I-130 petition is pending, but you may have to convince the immigration officer that you do not intend to stay in the U.S. This could be done through ties to your home that will require you to leave the U.S., and it can be more difficult for someone who has an I-130 petition pending, which shows that the person would eventually like to stay in the U.S.

Someone with a U.S. citizen spouse who is already in the United States lawfully and who decides they want to stay can adjust status, but it's illegal to come to the U.S. with the intent to do so, or to lie about your intent when you're admitted to the U.S.
