I-864 joint sponsor's income

I-864, Part 6. Sponsor's income and employment.

My income is not enough to be the sole sponsor of my wife. (Has been in previous years, but this year we have moved and I have been out of work until recently)

So in addition to me filing form I-864 to sponsor my spouse, I have asked my mom to help co-sponsor.

The question I have is my mom will be signing to I-864 as the co-sponsor, right now I'm trying to sort her income off the tax returns from the previous years. The problem is on my parents tax returns they have filed jointly. So we are having a hard time finding just what my moms earned income was.

Can we list just my moms current income on Part 6 #5, then used the combined income of my parents on Part 6 #13.a/b/c?

Her income is more than 125% above the poverty level for three people (mom+dad+immigrant wife). So no need to add my dads income and for him to file an additional I-864A.

If he does not file form I-864A then we just need to subtract his income from their join tax returns and put that on lines 13a, 13b, 13c, is this correct?

Its just not so clear in the instructions as to how to handle a joint tax return when only one will be the co-sponsor.

Any advice would be appreciated, its our last thing to finish and we are ready to start proofing everything in her AOS packet! :)

We used just my mom's income for Part 6 #5, then again just my mom's for Part 6 #13 a/b/c.

My parents still live together and file joint returns, but since my mom's income was enough independently we just used my mom as the sponsor rather than combining both parents. So Part 6 #13 a/b/c just have her income listed.

I don't think this is right. Part 6 #13 asks for the "total income" numbers from her tax returns from those years. You put exactly what it is from the tax return. Doesn't matter if it's filed jointly or separately.

Well it must be right, we had no problems and have finished the AOS process.

If you read closely on Part 6 #13 instructions it states MY INCOME, not joint income.
