Hello. Im in a bad situation right now. I petitioned my mom last year and everything was fine, but few weeks ago she decided she rather live with her sister in a different city where crime is rampant and the neighborhood isnt good. Im very concern that something might happen to her over there and Im suppose to be in charge in keeping her safe and providing for her. My mom doesnt work yet and my aunt already got her brainwashed about living with her in her house. I know I made an affidavit before I petitioned her, and Im responsible for her untill she gets her US citizenship but is there something I can do to reverse it??? I really dont want to be responsible if anything happens to her because she doesnt listen or care to take my suggestions and advice. Thanks.

The affidavit you signed is valid until your mother becomes a US citizen, abandons residence in the US or passes away. You can't reverse it.

If you did not want to be responsible for her you should not have signed the affidavit in the first place, which means you are the sole responsible for your current situation.

Hello, I petitioned my mom last year and everything was fine. But a few weeks ago she decided to live with her sister in a diffrent city where its not safe and crime is rampant ( she doesnt know that but I explained it to her). My problem now is she doesnt live with me anymore and I dont see her, whenever I call her my aunt intervenes or unplugs the phone, she doesnt like it when Im trying to make sense to my mom and she wants my mom just to stay with her and take care of her. I know Im responsible for her untill she gets her US citizenship but its just so unfair, if anything bad happens to her will I be held accountable for it and need to pay her medical bills etc?? What if she seeks public assistance?? She doesnt work yet and Im more than capable of supporting her but she dont live on my house now, what should I do?? Thanks.

How is it the petitioner's responsibility if the mom gets mugged?

responsible for the affidavit of support.. which she wants to null and void.. is my take..

not sure if affidavit of support covers muggings or Leary neighborhoods..

The affidavit of support doesn't make you your mother's keeper. It is a contract between you and the US government that you will provide for her so she doesn't become a public charge. It does not give you any authority to control where she lives or what she does. If she wished to take up skydiving she is free to do so, but if she lands too hard and received public benefits, that is your responsibility.

There is no way to revoke the affidavit of support, you are on the hook.

Posted

You are not responsible for her bad choices of where to live or who to live with. You are not responsible for her safety.

You are only responsible if she receives public benefits (for example: food stamps), you would have to pay it back.

I am not trying to control anything, I just want my mom to be safe and have a peace of mind thats all

Keeping her safe is not what you signed for, what you signed is she will not become public charge.

If your aunt convinces your mom to file for food stamp and she files for those than you are responsible for those.

There is no way to undo it, you will be responsible for her financially until she is US citizen.

please reread the I-864 that you signed - you kept a copy, right ?

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Missy muggings and crime have nothing to do with I864,

sounds like she is trying to get away from you now trying

to control her, it has to be more than safety issues for U

to get on the net trying to pull this from your mom..listen

up you got ONLY one mother, if she wants to live there let

her go with gods blessing...she did not abort, molest, or

abuse you right? don't do that , your own kids will treat you

later as they se you treat mom, I understand elderly parents

can cause us concerns at times, but if she's not senile or have

dementia ...understand , She LoVES you, just don't wanna

live with you. DO NOT DO THAT.

You got kids? maybe she don't want to be a built in baby sitter
