Hi, I am a German citizen finishing my studies in the Netherlands currently. I married a US citizen in January 2013 and we applied for immigration visa for I-30 which got approved. However, we did not continue with the process because my husband is a student, as well and we don't have the financial proof.

Now, I have been accepted to his university and also received a position for a full time assistantship. The university filed me my I-20 and I have my interview tomorrow.

However, I am worried I might get rejected the student visa because we had applied for a Green Card. We are no longer planning to live in USA in the near future since even after my studies nothing will really change on the finances I believe.

How can I proof strong ties to my home country? My problem is also even though I have my entire fmaily in Germany and we are planning to move there in 2 years, I am now registered in the Netherlands due to my studies and had to deregister from Germany.

Anyone from a European country has any experience in this area?

Any help is greatly appreciate!

Thanks

Since the F-1 is a non-immigrant visa, you will need to prove ties to your home country. I think this is different for everyone. From low fraud countries you could simply demonstrate your intentions to return. However, there will be a greater burden for you since you are married to a USC with a previously approved I130.

Please keep us informed on how the interview goes

good luck

Hello everyone!!!

I got my visa! It was a very smooth interview, I didn't have to prove any kind of ties to Germany. I went to the embassy in Brussels because it is closer and their processing time is faster. I had already disclosed in my DS-160 that my I-30 had gotten approved, but we had made changes to return to Europe due to financial difficulties in USA.

He officer said he understands my situation, but I should be ready that I might have to explain my situation while crossing the country again. He said it is also fine for me to visit my husband on the VWP before my school starts as long as I return back and enter on my visa again.

I was really worried..but I just got asked simple questions like where I study, whether my husband studies at the same university, what we will do in Germany after my studies, etc....I was also very lucky because the officer told me how he once worked for a US Senator in Michigan and he knew a couple professors who had graduated from political science from the university I will be attending this fall.

I think the fact that I had gotten approved for my I-30 and could have continued with my Green Card if wanted, that I am from Germany and had a assistantship made it very easy for me to be granted a student visa. However, I still cannot believe it and I am extremely happy.

Good luck to everyone else out there!

=)
