Delhi DCF| I 130 approved | Received Packet 3 & Packet 4 together with interview date

Hey there,

Our 130 was approved within 2 weeks and we received packet 3&4 together along with the interview date.

Do you think I need to mail DS 230 and 2001 before or should I just take it with me in the interview?

As usually, one received Packet 3 which is DS 230 and 2001 and one sends it across to receive Packet 4 which is about and then receives interview date.

Help please!

Hi,

Yes, to file the I130, you have to go to Delhi in person. I was in India for 15 years, and my husband is an Indian citizen. We were married for about 8 months before we filed.

Filed for DCF for my husband in New Delhi, India

Timeline:

29-06-2012 - Got Married in Bangalore, India

04-04-2013 - Filed the I-130 in person in New Delhi

No NOA1, NOA2, Packet3, Packet4

26-04-2012 - Interview Letter sent out

09-05-2012 - Interview letter received

24-05-2012 - Interview Date

Interview Result - Approved

Filing to interview date = 50 days!

Yes, I went to Delhi with my wife. We were married for 2.5 months when we filed.

She has been living in India since October and had a full time job. She also held OCI that made her easier to get a job/pan card / aadhar etc

Hello VJ Members..Thank you for your reply. My wife and I are preparing to do the DCF.

My wife (31) a USC and I (32) have known each other since 2008 while she came to India on her vacation. She came to visit me in April 2011 for 2.5 months.

We got married in April 2012 and she stayed with me for 3 months. We had a court marriage in Mumbai and did not have a separate wedding/reception as her family is not supportive of her decision because of an interracial union (USC Hindu/Indian Muslim). However, my family is happy for us.

She came again in January 2013 and has been residing in Goa with me since then. She is currently working remote for a US company and I am a doctor preparing for my US Medical License exam. My permanent residential address is in Mumbai. My wife is an Indian origin and has a multiple entry tourist visa. We got her FRRO registration and residential permit done in Goa.

We have many pictures (no wedding pictures), videos, financial transactions, receipts, boarding passes, flight tickets of travel together etc, accumulated since my wife's first visit till now. We have two affidavits from her cousin and his wife and I have 3 affidavits from 3 of my best friends who were all witnesses at our court marriage.

Sebring, I have a question; you applied for DCF 2.5 months after your marriage, so did you get the rental place after you got married and how long was the lease agreement? Exactly what kind of lease agreement was it, with a government stamp paper? I am asking since I have been living with my wife in a rented apartment in Goa for more than 6 months. We do not have any contract/lease/rental agreement since we did not plan to stay for more than 4 months. We have been paying rent on monthly basis. The owner does not want to make a pre-dated agreement of our stay here now. Is it ok to get an affidavit from the owner stating that we have been living here together for over 6 months? Is the affidavit good enough to prove our stay together? Do we need to get an electric bill for this rented apartment?

We are deciding to visit Delhi for DCF next week.

Also, since I have been staying in Goa for over 6 months, do I need to get a PCC from the Goa local police authority other than a PCC from Mumbai passport office?

Also, which address are the packages from the embassy sent to after i-130 approval? Is it my permanent address in Mumbai? Or our rented Goa address.

Do we have an option of where the packages will be sent from the embassy?

Please advise your suggestions and opinions.

I also applied for DCF a few years back in Delhi. I had a lease agreement, which was on stamp paper (that paper with a 100 rupee note on it). I also had electricity / gas and internet bills. However, that was mostly to prove my residence in India, since my spouse's name was not on any of them. If you can get such documents under your wife's name, that will prove that she was a long-term resident of the country (and not come just to file for DCF).

For the proof of relationship, we essentially showed lots of documentation that we are living at the same address. (Spouse's bills and my bills coming to the same address etc). We got letters from our employers stating that as well. We also brought lots of photos (not just of the marriage, but from later vacations, trips, birthdays etc). The officer sifted through them, and selected a few for the application. She didn't see our marriage photo album. The more variety of photos you have (in different locales at different times etc) the better.

For your address, the consulate will send to whichever address you put down on your application.

They didn't ask you anything if the lease was only on your name? Were the electricity/gas bills on your name, or the owner's name?

Also, were your pictures dated? Most of ours don't have any dates on them! Would this be an issue?

They didn't ask about the lease being only in my name. The main purpose of that was to establish my (US citizen) long term residence in the country. For proof of relationship, we showed proof that we lived in the same apt (bills coming there), and we also showed health insurance beneficiaries as each other. The gas was under my name (since it was a cylinder), and you are right the electricity bills were under the owners name. I don't think I took those. I guess I took internet/phone bills.

Our photos weren't dated either. We took a selection of wedding ceremony photos, and later photos taken during trips etc. The officer sifted through them and picked a few, but I don't specifically remember which she picked.

Hey Nirshd,

I had a standard lease agreement on a notarized stamp paper. We have been living there for just over a month when I filed DCF. I would suggest you to either get a notarized letter on a stamp paper by your landlord and get a copy of any of the bills.

if yes then what documents asked for i.e. resident permit, certified copy of marriage certificate.

Hi Maverick!!

We had gone for DCF in Delhi and they did not accept our application saying that my wife is not a resident. We took her FRRO permit and our joint residential lease. The Indian lady there didn't look at any documents (we think this is the crazy Indian lady that everyone talks about who has a problem with everyone!). She just took our passports, then came back in 10min and said there are too many exits/entries on my wife's passport so this proves that she mostly lives in the US; therefore, she does not quality to petition for DCF.

My wife has been living here with me since the last 9 months now!! However, we do know that they don't consider the duration of stay. They have been getting stricter by the days, although it was much easier before 2011 where just the duration of the stay of more than 3 months would prove the petitioner as a resident. The lady said FRRO is just a permit and the lease anyone can get. She said there are many other legal documents to prove my wife as a resident. She said they need "something that doesn't let you go back to the States, like a job contract or education or you should be paying income taxes in India".

Very disappointing, since we had all the evidences of bona fide marriage and 305 pictures, etc everything perfectly organized!

GOD is great and our LOVE is strong and we will go through this!! Wish us luck and best of luck to you as well!!
