i am an Indian citizen, currently residing in Canada on a work permit since Mar 2013.

i want to visit USA on a tourist/visitor visa.

can you pls let me know the procedure to apply for the same.I will be applying the visa from Toronto,Canada.

also can you pls let me know the chances of rejection since its been only 3 months that i have been in Canada.

your help wil be highly appreciated.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

The chances are high that you will be denied. This looks like you are attempting to immigrate to the USA via Canada.

You will have to prove ties to Canada because you have demonstrated few to India.

Best way to find out is to apply. Prior to doing that make sure you understand the strongest ties rule. Doing so could save you time and money.

can you pls put some light on what you mean by the strongest ties rule?

It would all depend on your situation, have you ever applied for tourist visa from India?

How would you show you would return to Canada and not overstay your visa in US? You only have been in Canada for 3-4 months.

You need to provide strong evidence that you would not overstay your visa and you will return back.

Hi Ning,

can you pls put some light on what you mean by the strongest ties rule?

All persons with ANY type of visa are considered to be " intending immigrants" by USCIS.

Strongest ties means what compels you to have to return to your country. Those ties must be so strong they can not be broken to allow you to emigrate to the USA.

You have to PROVE beyond a doubt that your ties are to India where you are a citizen which you can not do because you are in Canada where you have been for 90 days.

If you can not submit some info that indicates you MUST return you will be denied. The level of fraud committed by people from India is high so you must overcome a history of fraud in your application even though you have done nothing wrong.
