Hi, I am new here and would really appreciate any help.

My wife came here on a J1 visa, luckily it was not with a 2 year home country requirement. We got married in the beginning of May, while her J1 expires in August.

Last year I only made 20,000 in gross receipts (self-employed). Which is about 17,000 in Total income. This is under the requirements for the Affidavit of Support. I am trying to find a person who is willing to co-sponsor but so far I haven't had any luck. Unfortunately, her employment will be terminated once her J1 was scheduled to be over so we can not count that income.

This year am I scheduled to make at least 27k, but again this is self employed income. I can get a letter from a client stating a minimum monthly income of 2,500. Will this be enough to satisfy the requirements?

Is waiting until the end of the year, then filing/presenting a 2013 tax return an option? How long after a marriage is typically acceptable before filing for a green card?

I think it doesnt matter how long you wait to apply for a green card.

You could probably apply as soon as the next day. As long as it is clear that your intentions coming into the country were not to get married then I dont think it matters when you file.

I dont think waiting until the end of the year is an option. You have to show the most 3 recent tax returns as soon as you file for AOS. If you do not do this they will request for the information and if you dont send it in the time frame they give you, you can be denied.

I dont think anyone can tell you if your income is enough- because we dont know your household size.

Make sure you count yourself, your wife and anyone else you count as a dependent. Then you will know how much you need to make .

I believe if you have a letter from your employer showing you are going to be making over the poverty line it should be okay. But make sure it is an official letter. You will still need to show the last 3 years of tax returns (even if they were below the income level required). Also you can show pay stubs showing what you are making this year.

08/14/2013: EAD Approved and went into card production (via electronic notification)

08/14/2013: AP approved (via electronic notification)

08/17/2013: Received Hard Copy of interview notice

08/20/2013: Received status update e-mail saying combo card is being mailed!

08/22/2013: Received Combo Card in the mail smile.png

09/11/2103: AOS Interview at 10:50am!

09/11/2013: APPROVED!! good.gif
