I have a joint sponsor - just wanted to put that out there.

But I am aware as the petitioner I still need to fill out the 864. I only filed taxes for the past 2 years. So I will NOT be checking the box that says I filed for the past 3 years on form 864- even though I am including my most recent tax return.

On the cover page I will write that there is an explanation for not filing taxes in 2010.

FYI: didnt file them in 2010 because I wasn't making enough to file.

Can anyone tell me if this looks okay for my written explanation? I will attached 3 pages from the IRS publication showing who can be exempt from filing.

I, the petitioner sponsor, XXX, have not included a tax return for the year 2010 for the following reason:

  • In the tax year 2010 my income was $x.xx and according to IRS guidelines I was not required to file a return.
    • Attached is my W2’s from 2010 to show this income level.

  • Attached is the IRS Publication 501 for 2010 showing my exemption from filing in 2010.

I, XXX, certify under penalty of perjury under the laws of the United States that the information I have provided in this statement is true and correct.

Signed and dated.

06/12/2013: Received NOA Text Confirmations of Packages

06/15/2013: Received Hard Copy of NOA

07/03/2013: Biometrics Appointment Letter sent by USCIS

07/10/2013: Received Biometrics Appointment Letter

07/11/2013: Walk in Biometrics in Gardena,CA

07/17/2013: I-485 status changed to Testing and Interview

08/12/2013: Received status update e-mail with interview date

08/14/2013: EAD Approved and went into card production (via electronic notification)

08/14/2013: AP approved (via electronic notification)

08/17/2013: Received Hard Copy of interview notice

08/20/2013: Received status update e-mail saying combo card is being mailed!

08/22/2013: Received Combo Card in the mail smile.png

09/11/2103: AOS Interview at 10:50am!

09/11/2013: APPROVED!! good.gif

Looks good but I would lose the bit about certifying under penalty of perjury. It's not required, and why take on that responsibility if you don't have to? There's a different law that will punish you for making misrepresentations to USCIS, and that's enough for them.

Ah, I just feel like its basically an affidavit right? So i thought I would need to put something like that at the bottom ....

Does any one else know about this??
