My husband and I got married on 6th of May 2013. We both changed our last names from Jones and Marinova - to Trent. He is now in a process of getting new Social Security Card (SSC) and new driver's license with his new last name Trent, and after that we will apply for my green card. My question is - while i am filling out my documents for my green card, should i type my new last name? On our marriage license it says that my new last name is Trent, but my SSC and driver's license are still with my old last name Marinova, and i know that i cannot apply for new SSC for my new name until i have my green card (a proof that i can legally work in USA). FYI i came in USA on J-1 visa last summer, and my visa expired on 1st of Oct.2012. Thank u in advance!

AOS based on a marriage with US citizen:

06/06/2012 - last entry in USA on J1 visa;

05/06/2013 - got married;

07/18/2013 - sent the package (I-130, I-485, I-765);

07/23/2013 - USCIS received the package;

07/29/2013 - received notifications for acceptance via e-mails and text messages;

08/02/2013 - received notifications for acceptance via mail;

08/08/2013 - received biometrics letter (appointment for 08/14) via mail, without any e-mail or text message notifications;

08/14/2013 - done with biometrics;

08/22/2013 - I-485 online status updated to "Testing and Interview";

08/28/2013 - I-485 online status says " On August 28, 2013, we mailed you an appointment notice for an interview for October 4, 2013...";

08/30/2013 - received notification for an Interview on October 04 2013, 8:30 am via mail;

09/23/2013 - I-765 online status updated to "Card/Document Production";

09/28/2013 - received EAD card;

10/04/2013 - interview day - approved on spot!

10/17/2013 - received my green card via mail

Hi,

I havent actually sent in my AOS yet- but....

I would suggest putting your new names on the forms.

Your new last name is now Trent so you need to put that

I'm assuming the marriage certificate will be enough to show them you changed your last name :)

06/06/2013: Sent in AOS Packet!

06/10/2013: USCIS Received AOS Packet

06/12/2013: Received NOA Text Confirmations of Packages

06/15/2013: Received Hard Copy of NOA

07/03/2013: Biometrics Appointment Letter sent by USCIS

07/10/2013: Received Biometrics Appointment Letter

07/11/2013: Walk in Biometrics in Gardena,CA

07/17/2013: I-485 status changed to Testing and Interview

08/12/2013: Received status update e-mail with interview date

08/14/2013: EAD Approved and went into card production (via electronic notification)

08/14/2013: AP approved (via electronic notification)

08/17/2013: Received Hard Copy of interview notice

08/20/2013: Received status update e-mail saying combo card is being mailed!

08/22/2013: Received Combo Card in the mail smile.png

09/11/2103: AOS Interview at 10:50am!

09/11/2013: APPROVED!! good.gif

The certified marriage certificate will act as a name change document for USCIS. Use the name you will legally go by from now on on all the forms. The name you use is the name your green card will come in, so use the new married name.

But it sounds like Trent is not the husband's real name (or old name). He changed it himself through a court order. DId he do that before your marriage?

He applied for it in the court in Idaho, paid the taxes and everything, and he had just to wait until they look through his documents, but meanwhile we moved on Nantucket, and got married here, and the guys from town hall told us that it was pointless and waste of money and time to do it through the court, just because the marriage certificate has the exact same value as a court order. So right now he applied for changing his name on his SSC with the marriage license as a proof.
