OMG...case frozen since January, another RFE.

So back to your evidence.

I don't believe the story about 2 separate case files. Each of your applications will have a different number, is that what he is talking about? You send the application all together, did your lawyer try to send it separately? I just really really don't trust your lawyer. This is seriously bungled up.

1. To fix this, I would send a copy of USC's passport (it must be unexpired). This saves any silliness chasing down BC issues.

2. Is your marriage license signed by the registrar? Did you get it at the registry office?

3. Your husband must fill out his own I-864 completely and also submit all required extra information, like complete copies of tax returns. The fact that your lawyer didn't do this just reinforces to me how stupid s/he is.

4. I would do all pages of passport, color copy of page with stamp, an arrow to the stamp or circle around it, and a letter about how you entered on the VWP. Connect the dots for the adjudicator.

Did the lawyer even send the evidence back with the RFE letter?

This is page 1 of our RFE

Okay. You can see from the title of the page that it's a request for INITIAL evidence, meaning this information was not included in the original packet.

I think your attorney screwed up. Big time. I certainly hope you're not being charged for all this additional time cleaning up THEIR mess.

Here's what I would do. I would request from your attorney an EXACT copy of the entire package that they sent. I would also ask for the RFE copies.

I'd be willing to be they forgot to include all that information the first time and that's why you're being asked for it again.

i would also terminate your attorney and continue with the process yourself. Make sure to do this only after getting the copy of your file, which you are entitled to. If you have any problems with this, report the attorney to the ARDC.

OP: First of all, listen to and follow what Harpa is writing up here....this user is the prophet on immigration issues. Second, I had the same idea as Vanessa. I would get rid of lawyer real fast! She is doing nothing but just drilling a hole in your pocket. Because of her, you can get easily denied. I did not hire any lawyer and within three months from the date I filed I had my green card in my hand. I just followed the instructions, and asked questions on this board. Your lawyer should not get a penny from you and you should send her straight down to, you know where...just do it yourself, you're way better off!

I so agree with you.

OP if you went through this site and researched people who use lawyers you will see this so often. Evidence being left out , omitted. It's shameful.

Lawyers who actually tell people don't send in evidence it will be asked for when needed. Really can you imagine.

Personally if lawyer doesn't refund and give you the exact copy of what they sent you also tell them you are lodging a complaint against them with the state bar association. Just my 2 cents. ;)

Thank you all yet again for the great response to our big problem. We are trying to fill in the requested form of Affidavit of support I-864, and wondering what supporting documents we will neet to attach with it? Also, which form should we use, the short or long version? Our lawyer admitted that he did not fill out the I-864 for my husband....... he thought that because we have co-sponsor it would be enough to post only her form and documentation..... We are very stressed, and having a terrible time. Please help us. Thank you so much.

Because you have a joint sponsor the only form available for the petitioner is the I-864.

That shows how bad your lawyer is.

Follow the instructions. Your husband will need to attach a complete copy of his tax return (including all W2s, 1099s, and schedules), or a letter explaining why he was not required to file taxes by statute.

Does your husband work?

Edit: As much as you can, stop being stressed. That will only make your work sloppy. Relax and go through it meticulously and slowly. You can do it.

I don't know if this has been covered, but when my husband and I got married in GA, the lady at the counter told us that after the marriage ceremony we can come back and get our marriage certificate. She singled out the fact that we needed to get TWO different versions of the marriage certificate. One is specifically designed for Immigration she said and one we can keep for ourselves. And sure enough they are slightly different. So I am not sure how MA works but it will do well to ask. We sent the INS version of it ( as she called it). So far no RFEs. (touch wood).

I have a feeling this lawyer doesn't do many immigration cases. There is no real training for an "immigration lawyer" except for he or she calling themself one.

OP you really need to take the time to go through everything to make sure that you have EVERYTHING perfect. You have had 3 RFE's. You are very lucky they did not deny already. This will be your last chance and with a VWP denial you have no appeal.

Hi everyone, again, now that we have confirmed that our lawyer failed to submit an Affidavit of Support (I-864) for my husband, when he filed AOS on January the second 2013, we are curently doing that now, as it has been requested in our latest RFE.

This morning we went to my husband's employer and requested a proof of employment letter containing the following:

1.) The letter should be written on company letterhead

2.) Length of employment, including date of hire ( August 23rd, 2012)

3.) Annual income

4.) Is the position temporary or permanent

5.) Sign and list your title and please include the date

Does anything appear to be missing from our proof of employment request letter?

We are about to go and ask the bank for a Bank statement. However, we are having trouble, as we do not know exactly what sort of bank statement to ask for? And what it should include? Please can somebody give us a little list what such statement should include? Thank you so much.
