I'm helping a friend of mine applying for her Adjustment of Status and we have a question about I-864 form. She listed her income on question 24, letter b. Now, which letter should her choose?
d) The persons listed above have completed Form I-864A. I am filling along with this form all necessary Forms I864A completed by these persons

OR

e) The person listed above,(petitioner) does not need to complete Form I-864A because she is the intending immigrant and has no accompanying dependents.

Thank you! :)

The answer depends on who is the co-sponsor. Is the co-sponsor the immigrant? There should be the primary sponsor, the immigrants spouse so who is the other person helping out?

If the co-sponsor is a household member but NOT the immigrant then she picks D.

If the co-sponsor is the immigrant then she picks e.

It would be better if she switched to the latest version of the I-864. The one you are using has been replaced. It will be accepted for about one more month, so make sure everything is filed in the next few weeks so it won't get rejected. Or start over with the March 2013 version.

Sounds like you are using the old version of the form. There is a new one available and the old one will not be accepted after June 23rd. http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=b70f8875d714d010VgnVCM10000048f3d6a1RCRD&vgnextchannel=db029c7755cb9010VgnVCM10000045f3d6a1RCRD

As for your question, it will depend on whether or not the household member being listed in #24 b. is the intending immigrant or not. If they are a household member of the sponsor filling out the I-864, then they need to file an I-864A with supporting documentation. That would be someone you live with such as a parent, sibling or adult child that you are going to combine incomes with in order to meet the 125% requirement. If the household member being listed is the intending immigrant, then they do not need to fill out an I-864A.
