Did not send AOS papers since 2011.. can i still redo it? please need help!

The I-94, not the K-1 visa, is the legal presence document. You go by the expiration date on the I-94, and if the I-94 does not show when it expires, it is valid for one year from date of issue,

Unless someone has made a mistake at the PoE all persons entering on a K-1 visa have their I-94 expire in 90 days from the date of entry.

will it be a good advice for this couple to just call the uscis and ask for information on what to do??? i will think twice if i were in their shoes.

My Husband wants us to help them with their paper work through this website and i don't mind helping.

this couple's number 1 problem last time they did the AOS is money. and asking for an attorney to help is impossible

now that they are aware of her status(in danger, scared of getting deported) they just want to stay home and help the little business of the parents.

to be safe. looking for an immigration attorney i think is the last priority(the usc is disable)

I want to clear this again, they will re-do AOS through the financial help of the usc's parents.

Not all attorneys will charge, especially if you can find one doing pro bono work through an immigration advocacy group. The important thing is to get the AoS filed ASAP. They will have to pay the filing fee regardless unless they can somehow secure a waiver based on economic hardship. There are a lot of free and low cost resources available to immigrants in the US it is only a matter of locating a local organization. Since you mentioned that you met at church, perhaps you can see if the church would be willing to help with some of the financial burden and/or assistance in locating an attorney or social worker specializing in immigration advocacy.

Overstay does NOT require the help of a lawyer. If the couple can follow the instructions and fill out forms there is no need to waste money on a lawyer because of their situation. The overstay is completely irrelevant to the issuance of a Greencard.

If the USC cannot show enough income to support his wife, he will need his parents, or someone else to act as joint sponsors. One reason many people put off filing for AOS is for that very reason.

Why on Earth would they want to call the MISS-information line?!? Calling USCIS will only confuse them at best and at worse give them incorrect information--this is after being on hold for a very long time. Have the USC read the guided here on Vj and then re-read the guides here on VJ. Go to the USCIS website and download the new AOS form, fill it out, copy the old information, add new information from that date to present. Then go to the USCIS website and find a Civil Surgeon near-by and call them up on Tuesday to see what the cost will be and when the next appointment is. Get the physical exam completed and include that in the AOS application. Then wait and wait and wait. Then may or may not have an interview but they will have a biometrics appointment.

This is not rocket science. Save the money on a lawyer and have them do it themselves as their case is not complicated or out of the ordinary.

OK - what's preventing you from doing that?

You know the link to the guide (that's a plus) and they have all the info already from the AOS set filed previously (that's another plus) and the parents are paying the fees (another plus) and most likely will be utilized as joint-sponsers (another plus)

How did you know that their friends are from the Philippines. I never would've guessed that....just because the OP is from there? WOW!

I thought in the Philippines that everyone had to do an emigration interview (CFO Seminar) and there they were taught about the steps that had to be taken after marriage to gain legal status in the US.

No, I was from a PC...but the OP had the Philippine flag on her profile, and I was amazed people assumed that their friend is also from there? But maybe I'm still missing something even though I'm from a PC myself...LOL Thanks for your reply though!
