One more thing: there's the alternative. That is what I did. You file for AOS this year and you go over to your international adviser and tell him/her that you would like to keep your F1 status. That means while AOS is pending, you are still F1 student. Has bad side, but good side too. Bad side, you still cannot get a job outside of campus and your tuition is still high (if you pay for it). Good side of it though, if AOS fails, you can still stay finish up your school as an F1 student. That is what I chose at the time, it is safe®. Alternatively, you could tell him/her that you no longer want your F1 status, but that will mean that if AOS fails, you have to pack up and go home and cannot finish school. So, I recommend you to choose the first option what I also chose at the time. That way, AOS failing, or not, you can still finish your studies. Or, as I mentioned above, just file next year this time. Good luck!

We have been together for over 3 and a half year and just wanted to get married and start a family.

We have had a lease under our names for 3 years. We have several friends who are giving us the affidavit for bona fide marriage, we are opening a joint account this month and she makes over $20k a year. Does this look like a case where they deny AOS ?

No. You will be fine. Don't worry about being denied, your case sounds like a textbook AOS. Even if you make a mistake on the forms or omit something, you'll have a chance to correct it (RFE).

Well that made me feel better and we are planning on taking our finished papers to a lawyer before submitting, so we can spot a mistake and fix it.

No, no, I never suspected that you have weak proofs. I just told you the alternative as you seemed way too nervous about AOS. Sounds like you have good evidences, but then IO varies from case to case. All the best! We have been together with my now husband for five years before we decided to get married. I'm sure that was a big plus in the IO's eye as one who wants to get a green card so desperately and marry for that reason don't date someone for 5 years. LOL Anyway, all the best to you!
