My 2 year old daughter has an approved I-130, with her mother being the petitioner. As children do not have to attend interviews or obtain police certificates, can anyone shed some light on how her visa is processed? Someone told me that all she needs is the I-130 approval and she can obtain her PR card at the local consulate here in Toronto Canada.

Anyone know?

i have to bet that there is more work to do at National Visa Center, the NVC, for further document intake for visa application processing.

The green card is not issued until the visa application processing IS COMPLETE and the child has attended an interview at Montreal, and then is only issued inside the usa via postal mail drop to the petitioner's address in the USA.

Where is the child and mother, now?

They don't simply hand-out green cards.

After i-130 approval at USCIS, AOS ($88) and IV ($230) fees are to be paid at NVC, AOS docs and DS-230 forms together with the child's civil documents will have to be submitted. There's a mandatory medical exam (with applicable fees too) for all applicants, regardless of age, and the child has to be present at the embassy interview. Immigrant visa will be issued upon approval of the consul. Once visa and visa packet are received/delivered, the petitioner has to pay online the immigrant fee ($165) before the child enters the US. A few days/weeks after POE, the green card will be delivered to the US address specified on the DS-230 form.

Children need the AOS fees, forms, and documents. They also need the IV fee, forms, and documents. The only document they do not need is a police certificate. They should be attending an interview because the consular officer will need to see the original documents, or at the very least, if you did not OPTIN for EP, they will be returned to you.

Also a child is a CR2 not a CR1.

If it is a CR2 and not an IR2, the parents will have to remove the conditions on the card.

She will also need a medical. The vaccinations for a 2 year old will be a lot more stringent than those for an adult. Make sure her vaccinations are up to date and that you have proof from the health unit.

Can you clarify here exactly? When you say "her mother" do you mean her mother is a USC making this petition? Is this a biological mother? If that's the case then someone will have to clarify the steps for reporting a birth abroad. Is it too late to do this because of the child's age? I don't understand why a USC has to petition their child.

HOWEVER... if your child is indeed applying for a CR2 visa then she will need to attend the interview and definitely must have her medical done. I have been through this process very recently and if you come to the Canada forum you can become familiar with our visit to the medical in Toronto and also check out my consulate review in the reviews section for Monreal.

The fee for the medical when we went a couple months ago was $300 for adults and $150 for children.

At the NVC stage (please study the guides) there is a separate fee for each application meaning $230 (after the $420 paid for the I-130). There will also be the AOS (Affidavit of Support) fee of $88 but if there are two of you applying at the same time you will only pay this one once as it covers all of you. You will each also need to pay for the New Immigrant fee after the visa is approved so that your green card can be generated. This fee is $165.

If you look carefully at my timeline you can see that things happened pretty much side-by-side but that there are 3 individuals going through the process together. I'd be happy to answer more questions specifically if you have them.

ETA: I thought I remembered your name and answering some of this before but I may be mistaken. Unfortunately I don't have time right now to go looking through old posts. I apologize if I'm repeating myself.

Wow, this is some great info. Thank you all for clarifying.

The child and mother both were born and live in Canada. Mothers USC was granted when she was young by her USC parent and she has never resided in the US. This is why the petition was needed for her.

I am actually quite surprised that the child needs to attend the interview considering she is 2 and will likely not answer questions. Would make more sense for the parent to supply documents needed for her on her behalf, but I guess that's just how it goes.

I will check out the Canada forum for more info.

Yes, the parent will fill in all the paperwork but as a Canadian you are going to be filling out forms online. I, of course, completed them for both our children online. We all attended the interview together. They officer said hello to them I think but that was about it. They hung out with my USC husband and I completed the interview.
