House panel approves homeland bill, bars Brazilian immigrants

The House Appropriations Committee on Wednesday approved a 2014 Homeland Security funding bill with a bipartisan voice vote. The bill is expected on the House floor in June.

In a surprise development, the committee approved an amendment from Rep. Tim Ryan (D-Ohio), which would effectively end immigration from Brazil.

The provision was included in order to pressure Brazil to extradite Brazilian-born Claudia Hoerig to the United States for trial in the murder of her husband, Air Force Major Karl Hoerig. The Ryan amendment does not affect travel visas or visas for temporary workers, an aide said

It was passed despite urgings from Homeland subcommittee Chairman John Carter (R-Texas) and ranking member David Price (D-N.C.) that it would have far-reaching implications. The text of the amendment withholds all funding from the U.S. Citizenship and Immigration Services to process any immigration visa request for a Brazilian national.

This amendment—which was adopted by voice vote—restricts U.S. Citizenship and Immigration Services (USCIS) funds from being used to approve citizen-sponsored (I-130) petitions, employee-sponsored (I-140), and any other immigrant visa petition subject to USCIS approval submitted by or for a Brazilian national or citizen.

It's called polictics, nothing more and nothing less and it has been around from the begining of time. Sorry that for no other eason than of your country of birth your pawns in this. Needs time to play out perhaps years but maybe decades, case in point Cuba.

Technically isn't a K-1 (Fiancee) considered a non-immigrant visa?

Here is the Bill

SEC. 2. SUSPENSION OF VISAS FOR BRAZILIANS UNTIL BRAZIL AMENDS ITS LAWS TO REMOVE THE PROHIBITION ON EXTRADITION OF NATIONALS OF BRAZIL TO OTHER COUNTRIES.

(a) Suspension of Visa Issuance- Notwithstanding any other provision of law, no immigrant or nonimmigrant visa may be issued to a citizen, subject, national, or resident of Brazil until the President of the United States determines and certifies to the Congress that the Government of Brazil has amended its laws to remove the prohibition on extradition of nationals of Brazil to other countries.

(b) Waiver- The President may waive the application of subsection (a) on a case-by-case basis if the President determines and certifies to the Congress that it is in the national interests of the United States to do so.

© Effect of Unauthorized Issuance- Any visa issued in violation of this subsection shall be null and void

The K1 visa is like a visitor visa you can stay up to 6 months in the US. The Department of Homeland Security (DHS), U.S. Customs and Border Protection (CBP) officials have authority to permit or deny admission to the U.S. Even with a K1 they can still deny you access to the US. They know with this visa you have to get married and then apply for a adjustment of status. This is a immigration visa for a green card which the amendment will block for Brazilians. Looking at the whole process I think K1 will also suffer the same result.

it's my understanding that a k-1 visa is a non-immigrant visa with immigrant intent.

however, the wording of the amendment read 'immigrant and non-immigrant visas' so everything is covered. I think the reporter quoted back in post #1 got it wrong, missed the 'non-immigrant' bits.

still - it's just an amendment that was added to the immigration bill whilst it was still in committee . It's very likely that the version of the immigration bill that is passed by both houses and signed into law by the President won't have this amendment in it, all things considered (partisan bullying, presidential succor, etc) and to be honest, it's my feeling that the entire immigration reform act will never pass in the House of Representatives in 2013 or 2014 - there are other problems that the racy flamers (my term) in the House will poke at and poke at and poke at - so by the time it actually comes up for a vote - it will bear little resemblance to what is currently in the Senate Committee..

Please rely on the Partisan Pounding in the House of Representatives, for the next round of fun and hacking and whack-a-mole, aye?

Yeah! Tim Ryan's amendment was killed by the House and there will be no issues for Brazilians next year!
