House panel approves homeland bill, bars Brazilian immigrants



The House Appropriations Committee on Wednesday approved a 2014 Homeland Security funding bill with a bipartisan voice vote. The bill is expected on the House floor in June.

In a surprise development, the committee approved an amendment from Rep. Tim Ryan (D-Ohio), which would effectively end immigration from Brazil.




The provision was included in order to pressure Brazil to extradite Brazilian-born Claudia Hoerig to the United States for trial in the murder of her husband, Air Force Major Karl Hoerig. The Ryan amendment does not affect travel visas or visas for temporary workers, an aide said

It was passed despite urgings from Homeland subcommittee Chairman John Carter (R-Texas) and ranking member David Price (D-N.C.) that it would have far-reaching implications. The text of the amendment withholds all funding from the U.S. Citizenship and Immigration Services to process any immigration visa request for a Brazilian national.



This amendment—which was adopted by voice vote—restricts U.S. Citizenship and Immigration Services (USCIS) funds from being used to approve citizen-sponsored (I-130) petitions, employee-sponsored (I-140), and any other immigrant visa petition subject to USCIS approval submitted by or for a Brazilian national or citizen.

WASHINGTON - Ao aprovar na quarta-feira, 22, um projeto de lei para liberar recursos para a segurança interna dos Estados Unidos em 2014, o Comitê de Finanças da Câmara dos Deputados avalizou emenda que impede a emissão de visto de residência permanente para cidadãos brasileiros nos Estados Unidos. O projeto de lei será submetido ao plenário da Câmara em junho e, se vier a ser aprovado pelas duas casas do Congresso americano, comprometerá o atual esforço dos EUA de aprofundar sua relação com o Brasil.

Esse esforço de aproximação bilateral seria consolidado pela presença do vice-presidente dos EUA, Joe Biden, ao Rio de Janeiro e Brasília entre os dias 28 e 31 e pela visita da presidente Dilma Rousseff a Washington em 23 de outubro. Dilma será a primeira presidente do Brasil a realizar uma visita de Estado a Washington em 21 anos.

A emenda foi proposta pelo deputado democrata Tim Ryan, do Estado de Ohio, um conhecido defensor da extradição da brasileira Claudia Hoerig. Ela é acusada pela Justiça de Ohio pelo assassinado seu segundo marido, o major da Força Aérea americana Carl Hoerig, em 2007. Por duas vezes, nos últimos anos, Ryan apresentou duas vezes um projeto de lei ainda mais punitivo. Ambos os textos previam a suspensão da emissão de qualquer tipo de visto aos brasileiros enquanto Claudia não fosse extraditada aos EUA. Essas tentativas, porém, fracassaram.

O presidente do subcomitê de Segurança Interna da Câmara, o republicano John Carter, e o deputado democrata David Price apelaram pela retirada da emenda, que impedirá as agências de imigração americanas de gastar recursos financeiros no processamento de pedidos de residência permanente (imigração) apresentados por brasileiros. Sem recursos, as solicitações serão imediatamente negadas. Os pedidos de visto para turismo e trabalho temporário, entre outros, não serão afetados.

"A assassina do major Hoerig tem de voltar aos EUA para ser submetida a julgamento, e nós temos de enviar ao Brasil a mensagem de que sua conduta não será tolerada", defendeu Ryan. "Isso tem de ser doloroso para o governo brasileiro enquanto Claudia Hoerig não for extraditada."

O Itamaraty acompanha o caso desde o início e, neste momento, se mostra preocupado com a chance real de o projeto de lei ser aprovado pelo Congresso, por tratar de um dos raros temas de consenso entre republicanos e democratas - os gastos com segurança nacional. Uma vez aprovado ontem o texto, com a emenda restritiva à emissão de visto de residência a brasileiros, a Embaixada do Brasil em Washington pediu à Câmara a versão original para estudá-la.

A contrapartida exigida pelo deputado Ryan é impossível de ser oferecida pelo governo brasileiro. Entre as cláusulas pétreas da Constituição está a que proíbe a extradição de cidadãos brasileiros. Em 2009, quando o governo americano pediu a extradição de Claudia, o Itamaraty explicou essa situação e ofereceu, como alternativa, a abertura de um processo judicial no Brasil contra a acusada.

Os EUA aceitaram. Mas, no ano seguinte, voltaram atrás sob o argumento de que Claudia não era mais cidadã brasileira. Ela teria renunciado essa cidadania ao adotar a americana, em 1999. Segundo o Itamaraty, o Ministério da Justiça ainda não concluiu o processo de revogação da cidadania brasileira de Claudia. Ela, portanto, continuará a ser tratada como nacional, protegida de pedidos de extradição. A opção do processo dela no Brasil continua válida, com base no Código Penal, mas teria de ser iniciado a pedido dos EUA.

OMG you guys! That is awful! This bill can't pass! That's ridiculous!! Ban visas to Brazil?? We're like the least harmful country to the USA!! That's so insane I can't even process this information right now. And WHY isn't Claudia in the US already??? Send her back!!!!!!

This is bullshit (forgive me). I truly don`t believe it will happen. America has so many crazy people shooting kids in school, cinemas, universities...everywhere. They are killing themselves. It`s not another crazy Brazilian human being that will change the whole relationship between Brazil and USA. Relax guys! It won`t happen!

I am Brazilian living in London, going through this annoying waiting process to finally be with my love. Let`s have faith!

First this is insane Tim Ryan (D-Ohio) remember this name so you can vote him out of office. Start a letter writing campaign or maybe we can go the president website. This is crazy the US has been talking about lifting the visitor visa requirement in 2014 with Brazil. Obama just made a visit to strengthen our relationships with Brazil. Brazil is becoming a world economic power Tim Ryan (D-Ohio) is so self serving. Did he forget the number of people who lives he is effecting for one person. I was a independent but now I thinking of becoming a Republican. I guess I maybe moving to Brazil to be with my wife and family. First we suffer from the bureaucracy of this process we are going through. The amount of time we are separated from our loved ones. This is a slap in the face to all of US with Brazilian spouses. Not to mention the number of illegals who will become citizens. What a great lesson this is for US citizens doing this the legal way. There was a question before from someone about K1 visa yes it will be included with this ban. If this passes all we will be able to due is visit or move to Brazil.
