SSN and Adjustment of Status

Hi guys,

Quick qu estion. I moved to the US on May 14th, got married on May 19th and applied for a SSN yesterday. There, they told me that I wasn't eligible for a SSN until I did my adjustment of status. Now, I know that K1 holders are eligible for a SSN, and since I didn't plan on taking my husband's name I figured it didn't matter whether or not I applied before or after the wedding. Guess I was wrong? What should I do next??? Thanks!!!

Tell them they are wrong and apply again. Ask for a supervisor. You don't need to mention you are married, it doesn't make a difference but some people there think when you get married you somehow turn into a K3 which is WRONG. You are still a K-1 asking for a SSN.

here in vj there's a chart you can print where it states all the people who are elegible to apply for SSN. I've to printed and take it with me cause I went through a similar situation. But when this ssn worker finally realized she made a mistake, she couldn't process my ssn cause my I94 was about to expired. (if your I94 expires on august, you can apply only until 3 weeks before your i94 expires)

So I've no choice but waited for my work permit.

Talk to the supervisor, take your paperwork with you and explain the situation. The window workers often times aren't very helpful and won't do anything until they get the go ahead from the supervisor.

If you remember the details of the last visit like date, time, local office, and the person who "helped" you, you can write an e-mail the the main SSA office listed on their website explaining your situation. They usually send an e-mail explaining what you need to do and to help educate the SSA empoyee. As Harpa states, you are still eligible for a SSN until you are within 2 weeks of the I-94 expiring. You may or may not be in the SAVE database depending on update cycles. Some have been able to apply the next day after arrival and others have issues.

They made a mistake, I remember I told the guy I need an SS to get married (false, but I really believed it at that time).

To a degree, I regret applying, because it came with a big ,,Not authorised to work without DHL" or something of that kind, so you may want to change it after you get the GC or at least the combo card.

Just for the above, the combo card will not take away the "NOT VALID" wording. Only the GC will do that.

I have already aplied for a new one with the combo card, and the lady said eveything is fine, and that I can get a free one. I guess we will see this or next week.

'DHS Authorization' is the EAD card or green card.

IMO, this verbiage on the SS card is a non-issue,

as

you can't work prior to EAD, and

You gotta show the EAD or Green card anyway, per the I-9.

Having the SS card with the wording on it is absolutely useful when you want to do things like setting up bank accounts, filing a tax return, etc.

Who shows anybody the actual card? All I have ever done is rattle off the number. I think I have seen my SSC maybe three times in my life. It resides in the safety deposit box. It also has the wording "NOT A VALID FORM OF IDENTIFICATION. FOR TAX PURPOSES ONLY" and you can see how many people pay attention to that now. Should the wife go for USC, we will make the trek to the SSA office and wait for hours and change her status with them. Until that tilme her card will have the "NOT VALID FOR WORK WITHOUT DHS AUTHORIZATION" Does not bother either of us as you can use the GC as a List A document and then you do not need to show the SSC. Only give them the number so they can withhold payroll taxes from your paycheck.

Got the SS card today, it still said NOT VALID FOR WORK WITHOUT DHS AUTHORIZATION, I guess it is because the combo card is temporary. At least got my name updated on it. Applied last Friday.
