I was married but since we was having problems with my ex wife we were separted so I met this girl it was arranged between my Mom and her mom to get to know each other so we met like a few times and took pics with her and with her mom and my mom and her cousins we met between December 2010 to march 2011. I left the country on march 2011. after I left I divorced my ex wife on may 2011 and then a couple of months later i started thinking to engage her or to ask for her hand. We both liked each other but due to my ex wife she was scared if I still love her or anything I asked for her hand from her parents she said she will think and give me her decision she said yes on April 2012 I was in the untied states I then started applying for her k1 visa. On October 2012 we started talking on the phone from April 2012 until now they have me RFE on may 15 2013 to proof we have met from oct 2010 to oct 2012 and proof of my termination of marriage that my divorce paper wasn't enough can some one please help me what should I send for proof of meeting we only met like 5 times I have pics please help

First of all: When did you file your petition? What is the date on the I-797 receipt?

A very basic I-129F petition requirement is that you have met in person 2 years before filing the petition. You need to send evidence of this meeting. I don't think photos alone are enough. Do you have passport stamps? Plane ticket stubs? Or bank statements from withdrawing cash or using your card in Yemen? Look on the Guides section of this site for examples of supporting document evidence for the petition.

What did you send as proof of divorce? Was it the divorce document from the court? Was it translated professionally? Need more info. Did they give you an example on the RFE form of what they still need?

I filed my petition on October 2012 and I sended my court papers for divorce they need two witnesses testament. I have passport stamps I left Yemen on march 2011 I have proof but when we did meet I was still married but separted and that time . I divorced on may 2011.

OK wait, USCIS asked you in the RFE for witness statements? Or was this from your court documents? If you need witness statements because USCIS requested them then you should have the people who accompanied you to the court write an affidavit attesting to the end of your marriage or relatives. Affidavits are supposed to be notarized. Good luck to them in finding a notary in Yemen. Please let me know if you are able to locate a notary agent in country I would be curious to know how you find one. I had a difficult time doing that for my fiance's petition. It was a different sort of document from a divorce affidavit though.

Also, I have to be honest. Your timing sounds fishy. You met this woman in 2010 and 2011 while still married. In what context did you meet her? Were you looking for a new wife while married to wife #1? You and I both know men and women don't interact socially unless they are related. Is she your cousin? Your fiancee may have a lot of trouble when and if this comes to the Embassy stage especially since, as I recall, you married and divorced your ex-wife in Yemen where things like civil document or court decrees don't have much merit and it seems like you jumped from one wife to the other quickly. But you're the petitioner, not the beneficiary so maybe they'll go easier on your fiancee. You have to prove to them beyond doubt you are divorced.

Salam send them ur passport stamps of when u entered amd left yeman send pictures and also it helps having ur family and her family write letters that they knew of your meetings, and also you should write a letter about your relationship and also where u seperated from ur now ex-wife at the time when u met ur current fiance ?? Just make sure to include all that;)

It say a statement sworn or affrimed by 2 people other then yourself or the person you petitioning for who were living at the time the event occurred and who have personal knowledge of the event your are trying to prove. The person making the affidavit may be relative and not need to be u.s citizen. Each affidavit must contain the following information the person making the affidavit his or her full name and adderess and date and place of birth relationship to you if any. Full information concerning the event and complete knowledge how she or he acquired knowledge of the event. This what it say I would like to know does it have to be notarized and when they write the affidavit do they need 2 witnesses to sign. Please someone reply

Normally affidavits here in the US are notarized in the presence of one or more witnesses. But I'm not sure if this is done in Yemen because my fiance looked around for a notary for a different document and couldn't find one. Maybe have one of your relatives go down to the local courthouse and ask. The US Embassy purportedly has notary services as part of their Citizen Services Unit but they don't have open appointments last I checked. I would say if you can't locate a notary just have the 2 people write their statement and sign and date it. This is what my fiance did for his letter of intent to marry. Remember this document also will also probably need to be translated.

OK but I'm still not clear what they want these affidavits for, Fayez. As secondary proof of divorce or proof of meeting your fiance? What you should do is scan a copy of the RFE, blur out your personal details, and post it on here so I can advise you better. As to notary or not what you should do is call USCIS. Do they list a phone number on the RFE where you can call to ask questions?
