I'm just curious....as my wife's green card has her maiden name on it. Did I mess up? She has already had it for almost a year and a half now...and we have not had any issues....I'm just thinking about it now for some reason smile.png

Thanks....

My wife's has her married name on it.

As you said her married name, I'm assuming she does by her married name now, and not her maiden name. So I'd say you missed the boat on getting the right name on the green card. I believe you can correct that when you file for ROC. Or if she already has the 10 year, then when she applies for citizenship.

If she is not going to use your surname as hers and is keeping her name as was... then no you didn't screw up. But if she had planned to take your surname as hers and do the traditional married name - then yup you screwed up.

Contact USCIS about correcting this is my suggestion.

I just got mine and it's in my married name. All through-out the immigration process we used my married name - on the forms, had my passport changed to my married name, etc. Did you use her maiden name during the process and her passport is still in her maiden name? If so, that could be a reason why her GC is in her maiden name, but that's just my assumption.

It is a bit tedious to change all IDs from the maiden name to the married name in the Philippines. For some, if the passport in the maiden name is not yet expired, they just let it be and would just change the name to the married name when it's time to renew.

The Green Card will be issued with the name she had on her passport. If she didn't change her passport to her married name before she finished the visa process she was out of luck. If she wants to change the name now she will have to get an updated passport from the Philippine Embassy here in the US before she can get her Green Card changed.

The name on the green card would be the same one you entered on form I-485 when you submitted the AOS packet. Since the marriage document acts as a legal name change we had entered her new married name on all forms. My wife's GC came was issued with her married name.

After we received the GC we went to Social Security office to update her name there.

My wife's 2 year green card was issued in the name on her marriage license, not the name on her passport.

When we finally got around to visiting Washington DC, she went to the consulate and registered our marriage. At that time she changed her passport to the married name which then matched the green card..

Did you apply for K-1 visa? Everyone I personally know that entered on a CR-1 had no choice in the matter and the GC was issued under the name present on the passport.

Looking at his timeline, they went K-1. So yep, he ran through a different process. My wife and I were K-1 also, so its interesting to hear how it works on the IR-1/CR-1 side. I'm sure its common problem with the spouse coming in with a maiden name passport. They put so many hoops to jump through to get it updated.

That is true for the K-1, but for the CR-1/IR-1, the name on the visa must be the same as it is on the passport and the GC is issued upon arrival in the US and will be the same as the name on the visa.

My wife's 2 year green card was issued in the name on her marriage license, not the name on her passport.

Again this is only true for a K-1 visa. For the spousal visa it is an entirely different sequence of steps as both are already married.

OP: Maybe you did screw up, but I think your wife has some of the blame as she should have decided whether she wanted to use her maiden name or married name and then changed the name in the passport if she wanted to use her married name. You can fix the US side of things when you file for ROC or USC.

Good luck,

Dave

I think what the OP is trying to say is that his wife's maiden name is also reflected on her green card (aside from her married name)?

Opps. I just re-read the OP's title. His wife' green card has her maiden name. They can correct this when they finally file for removal of conditions. First file for report of marriage to the philippine consulate so she can change the name on her phil passport to her married name. Good luck OP.
