Frank,

What if the Consulate Officer asks you the following question:

Are you not reporting all of your income to the IRS so you can pay income tax?

Honestly, I don't know how this works, b ut it seems to be opening up a question of income tax fraud.

You better not report this or they most likely will report you to the IRS for fraud and the IRS could come after you. But you can go back three years and and do amendment returns on your own. Since we are doing 2005 this year you can do amendments for 2002, 2003 and 2004 but you have to do it by April 15th for 2002. I think it would be best that you go back and do admendments for the years you can even if you will owe more taxes. Because with the immigration procedures honesty is always the but policy and it will also let you get full credit for your true income.

Good luck with your admendments and your case for your spouse.

If it isn't reported, in the US Government's opinion it doesn't exist. You shouldn't count on that income unless you report it...
