Well here ends the long road :) I had third meeting with a fraud officer here:) The person seemed like a good officer (the card said "Investigator National Security" Was at the local USCIS office, I feel very blessed that I was able to talk to a person three times considering I had no A number to start with, I think I had meetings with someone that really cared about the situation I was in, :) They were very polite and quick to help I submitted evidence all three times (police reports of her domestic abuse, proof she lied under oath to get a false Order of protection, False Restraining Order, statements about her abuse of me and my son) I was told "there is a whole unit that deals with her claim, they will get all this evidence you have my word, I will make sure it gets in the file" I hope that it makes it into the file at our second meeting they said "we will recall the file and I will personally place these papers in her file" I do HONESTLY hope they will keep there word, their last parting words to me were "there is fraud all over the system, in I-751's, I-360, and in the VAWA system itself. We will make sure your stuff gets to the right investigator "up north". They were very encouraging and helpful through the entire process even the clerks at the info pass desk that seemed to be as smart as door lock, (not very helpful :( ) The folks upstairs were great all three times we met, I am still shocked they saw me three times. But they would not have if they thought I was lying or a bitter ex spouse, or at least that is my thought.

And so ends the journey :( I loved my wife more than my own life, I was defraud, accused of abuse, my reputation at work_ has been effected and I have lost my faith in people I guess to some degree :( I have found that Her claim is based on fraud statements and Lies and I think the folks at USCIS see the same even though they say " it just is what it is" " we take a look at both sides" and things like" it all depends on the evidence" and yes it looks like she did give false statements to the court they will call and verify if they want to, you gave great info. "Now you need to have faith in the system and let the system work"

Now I am left with the thoughts, I am much wiser and smarter, and will not be so blinded by LOVE, would I do it again ...yes...I just know to be more careful :) Now I am also thinking how may I help others with what I have learned, how to help someone else, so they will not be in my shoes? I do not believe god gives me things I cannot handle and this was no exception to his rule. I want to thank everyone...SandraJ, Capri...your the best...a very public THANK YOU, and to the rest THANK YOU also some of you helped save a life in December last year. Thanks, she will not be charged on domestic violence, but was sent to the grand jury, I no longer have the I864 around my neck, she can never come after me again, and she can never try to press charges on me for the rest of her life or mine. You waded through the pain and ended up on top, si man. Your persistence has been very impressive.

You can help others by hanging around VJ to offer counseling, when appropriate. If your interests change and you fade away, it's understandable, and I among many wish you very well, si man. good.gif

Edited to add: It would be nice if the fraud-investigators were to provide you something in writing, in case there's residual trouble with clearing your name on any front. Even something like "this is to confirm that Brian1967 provided documentation about ___, ___, and ___ issues, which we consider to be legitimate and have accepted in full for further processing."

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I hope you can rest easy now Brian1967. I'm sure is been a real nightmare going through being charged with abuse, when you did no such thing. The system can really suck, and unfortunately its impossible to create a perfect system. Maybe with people like you speaking up, and letting their voices be heard, someone in congress will take note and do something to protect both sides in alleged abuse cases. Currently and for a long time, one party has been able to claim abuse by another, and even if its proven false the stigma has remained on the person accused, while nothing happens to the person who lied. Or rarely does any thing come back on them. Occasionally you hear of a charge of filing a false police report, and a slap on the wrist, but mostly the false accuser has everything to gain and nothing to loose. VAWA has created a situation where false accusations give them even more to gain. I'm not sure what the answer is to prevent abusing the system, while at the same time protecting those that are abused, but I sure hope someone does. And maybe fraud officer is right, maybe we just need to trust the system we have now. Although a bit more transparency would be a good thing. People could possibly see there is a reason to trust in it.

Oh yes! praise the Lord our God.

No matter what......TRUTH will always come out and prevail.

These are trials or tests of life to make us better persons....smarter and stronger individuals.

I'm sure the lessons you've learned will enable you to take good care of your heart, and get to know very well the person before you give your tender heart. I too learned great lessons in my journey. :)

Good things will still come your way. Be Happy, as we have an awesome God !
