I'm not sure what else to explain. File the I-130 with a CO at your infopass appointment. If you have all documents together and are filled out they will review it with on th spot and you more less recevie NOA1&2 at the meeting. Then it's just the packet and medical which can go very fast. If you wife doesn't qualify for DCF you will have to file over a Service Center in the US and Frankfurt will process it in about 12-18 months. Also if you haven't applied for CRBA, the consulate will require you to do this first, even if your wife doesn't have a claim.

Hi Mark,

Just wanted to share my experience. As you might remember, in our case the mother is a US citizen and I am, the father, is a Green Card holder. We got the baby transportation because of father’s green card! This worked for us. We asked this US consulate Frankfurt and the CBP said that “Any US Permanent Resident parent can get the transportation letter” Very happy J

Our baby got the NA-3 stamp at the airport but they did not give us any other document. Could you please let me know how can we apply for the US passport for our baby under CCA because the required documents link you mentioned is now “not found”

Do we need to apply Social security 1st?

That is excellent information! I hope this helps others, since the last information I had only was for the mother.

Our baby got the NA-3 stamp at the airport but they did not give us any other document.

You should have gotten an I-181, but as long as the NA-3 got the endoresment stamp (see here: http://imgur.com/idQUeWC) you're good.

I would definatly recommend going to a DOS passport agency instead of a post office for this. By law, you do NOT need a social security number to apply for a US passport.

--Applying for a US Passport under the CCA--

Now, for applying for a US Passport under the CCA you can go to any passport processing location like your local Post Office. If you live in a city like San Francisco or Boston the person processing your application will likely be familiar with the CCA and required documents. If you live in a small town in the square states with hardly any immigrants you will get an evil look and no passport wink.png I would recommend going to one of the DOS Passport agencies (especially if you live in one of the cities where these are located). These agencies deal with children, passports and the CCA on a daily basis. This also gave us the advantage of picking up the passport two days later.

At the passport agency we (both parents!) had to appear with our baby. We needed all the documents listed on the link below. The DOS agent was very friendly and knew exactly what to do. They keep all the documents for scanning and filing with the application. Now the DOS recognized our child as a US Citizen and it was official!!! Two days later we picked up the passport with all documents and that was it.

Hi everyone

I am a US citizen my husband is not non citizen i delivered my baby out side US. And i apply for CRBA which was denied because the Co wasn't satisfied with th evidance i provide as approve of physical presence for5 years so i applied for i 130 for my baby so my questions are

1- does applying i 130 for my baby without applying for his father will affect his case or cause denial of i130

2- can i apply for transpirtation letter for my baby as i 130 takes very long time

No, but it will raise red flags.

If you read my first post correctly, only the green card holder can apply for a BTL, not a USC.

If you're parents are USC's you might want to consider the grandparent route. Anyway you are going to do it, will take a long time.

You filing i130 for your baby alone will not raise a red flag. Why would it be? Its your kid!

I-130's are for immigration purposes. Sam mam's objective is though, to seek USC for her child without the father, and hence has no intent to remain in the US.

Thanks for answering / in fact i don't want to apply for my husband because he has a very good job right now and he will not find good job in US unless he did the exams (USMLE) he is a doctor so i will apply for him later after finishing his exams /our plan is that me and my kids will move to US To live with my family ( my father mother and two brothers ) and he had to take the exams as i said and follow us

Your story sounds plausible, so I don't think you will have problems there. But remember: If your husband wants to follow you to the US in the next year or two, you should probaly apply at the same time.

There are other options (like B-2 visa, N-600K, N-400), but you will need to provide more background information (like what nationalities do you/your child already has, are the childs grandparents USC's)....

(Day 88) 04/23/16: In line for oath scheduling *Called USCIS to inquire about why there is an oath required for a child under 14. They sent a service request to the field office.

(Day 95) 04/30/16: Received letter from field office to say no oath necessary and that they would mail the certificate.
(Day 106) 05/11/16: Cert of Citizenship received by registered mail (they never sent tracking. case status was never updated either)
