k-2 for unborn child

My fiance is pregnant now and the child is not due until May 2008. I want to submit a K-1 visa now and of course want the child to be included. The child will not have any father so there is no issues of custody, the mother will not name any child on the birth certificate so the way is clear for her to bring the child without permission of any father. When does a K-2 need to be applied for. Does it also take as long as the k-1? Can i include an unborn child on the k-1 visa application?

If the child is born the K-2 can be done right along with the K-1. Until the child is born no visa can be issued to the child.

you cannot list an unborn child on the 129f. if child is born before interview, the child can be added at the embassy level and be eligible for a K-2.

And if it's not born yet.... it'll follow the mom right along of course... :P

BTW, I think you meant May 2007... not 2008 :D:blush:

OUR COMPLETE TIMELINE

Latest steps:

10/26/2006- Consulate receives case (seriously, one month to receive the case?? BS!), and packet 3 that I sent even before they had received the case.

01/02/2007- Interview!!!!!!!!!!!!! Got a 221(g)

01/23/2007- Second Interview. VISA granted!!!

01/29/2007- VISA arrived.... no envelope though. I'm gonna contact them and see what happened this time!

01/31/2007- I'll have to send them one last financial support evidence.

02/01/2007- Evidence sent

02/02/2007- Evidence received by Consulate

02/06/2007- Consulate sends envelope!

02/07/2007- Envelope received!!!

02/10/2007- Flew to the USA!!!!!!

04/17/2007- Wedding day!!!

Because it isn't. "Not name any child on the birth cert." that doesn't make sense. I assume he meant 'father'.

May 2008!!! Gosh that is going to be a very long pregnancy indeed! I thought 9 months was long enough!

On a more serious note, I am in a similar situation, our baby is due in January and we are currently waiting for our interview date at the Embassy. I have decided to have the baby in England so our Lawyer has advised me to inform them at the Embassy and they will issue a K2 at no extra cost, although the baby will have to for the medical. I will also register the baby as a UK Citizen when it is born. If you would like you can PM me about this subject.

06/17/06- sent New I-129F petition to VSC.

07/26/06- NOA1

07/07/06- IMBRA RFE sent from VSC

07/20/06- IMBRA RFE received at VSC

09/29/06- NOA2

10/17/06- received Packet 3 from London Embassy

10/25/06- Medical

10/27/06- Sent Packet 3

12/13/06- received Packet 4 from London Embassy Interview scheduled for 19th Jan 2007

12/14/06- Emailed embassy to Reschedule interview

01/08/06- received Packet 4 new interview date 26th Feb 2007

The child does not legally exist until it is born. This means that the child has no name until born, so you better wait for the child to come out,get a name and then include them in the stage your paperwork will have reached at that point.

On another note, if this child does not belong to you, how long have you known each other? Did she go making babies when you still knew each other? It appears the pregnancy is less than 6 months, so do you mean the baby was made less than 6 months ago by someone else other than you and you claim to have a rship? If so, I would question the validity of your relationship and hence maybe not entitled to a K-1 visa.

A visa cannot be issued for the child until after it is born.

Our journey started in 2001 and it's still not over. It's been a rollercoaster ride all the way! Let me off - I wanna be sick!

Your fiance should list you as the father--if you are the father of the child. If you are not--then you will probably have a rough time proving the validity of your relationship--since your fiance was obviously involved with someone else very recently.
