He is disqualified from sponsoring you only if he offended under the Adam Walsh act (sexual crimes against children). He may have a delay if the crime indicates he will be a serious danger to you or any other family members immigrating with you. People have been known to successfully sponsor an immigrant spouse from prison before, so the simple fact that he has a criminal record is not, by itself, a bar to his sponsoring you.

It is unusual to have biometric requested for an IR1/CR1 visa, though. If your husband is not an offender under the Adam Walsh act, then it is possible that there is an offender with the same name and they are trying to prove they are not the same person. That would also explain why your I-130 case has been delayed for so long (extra FBI checks).

I'm a dual US/Hungarian citizen (both by birth; Hungarian citizenship verification TBA), and my husband is a dual British/Irish citizen (by treaty) from Northern Ireland. We are atheists.

Delay is not the same as denial. You didn't mention what your husband was convicted of. If it didn't fall under the Adam Walsh Act, and he has no warrant out for his arrest for a serious felony, you will probably be all right eventually. Please consider a consultation with an attorney experienced in immigration matters involving people with criminal records. Don't say too much about it here before you contact an attorney; you never know who reviews these boards, and you don't want to innocently mischaracterize your husband's situation.

Definitely contact an attorney experienced with Adam Walsh cases. There is a waiver that the sponsor may qualify for, depending on the circumstances of the case. We can't help you with this here on an Internet forum. Good luck.
