How did you have a Social security card and driver's license with a B2 visa ?

Im not sure what are the implications of having "fake" documents (assuming they are fake). If they are not fake then again you should be fine

Easy, 27 years ago, you could get a SSN just for asking and at the time, there was no I-9 verification..

I don't thing that I ever claimed to be a USC, never filed an I-9 form, never voted/ served on a jury.

Are you sure that they would forgive a 27 year overstay and work?

I-9s did not start until the 90's if I recall right....

OP, have you had the same job since you got here? If you changed jobs after the I-9s came into effect, it is not a form you file, your employer keeps it in their files. If one ever was filled out for you, the hope is that the "I am a US citizen" box wasn't checked. Also, do you have a drivers' license? That is another area where problems re: citizenship could arise - many states require proof of legal standing in the US now. I am in Texas and had to wait until I received my 10-year green card to just change my address on mine (my old one had expired and I was on my 1-year extension letter to prove my legality).

I have had a few jobs under the table and they never asked me to fill out an I-9 form. The last time I renewed my drivers license was in 2010 and when I renew it next April, I WILL be asked to show proof of legal status in the US because of the REAL ID act of 2005 that Ohio just adopted. Again, I don't think I ever claimed to be a US citizen on any other forms.

I just want to be sure that I won't be denied an AOS because of my 27 year overstay and work. I can't imagine living anywhere else. I've been here almost my whole life.

Sometimes I don't understand the members of this forum. So here is someone who overstayed 27 years and everyone is so supportive to him/her. In another thread there is a person who overstayed 2 days and got sent back on an attempt to re-enter and everyone is bashing him and beating the ####### out of him.

In another thread there is a person who overstayed 2 days and got sent back on an attempt to re-enter and everyone is bashing him and beating the ####### out of him.

You don't see the difference?

You can AOS after being out of status/illegal for many years if you get married to the USC (and don't leave the country after getting GC).

If you leave the US after overstaying and want to come back as a tourist, that is totally different story.

Those two are a completely different stories.

Besides the OP attitude is a factor in replying as well.

Well this OP has a path to a GC, and the highly positive factor of being married to a USC.

And this OP, unlike the other, hasn't insulted anyone and doesn't have a false sense of entitlement.

OP: Good luck. Like Boiler said, a quick consult with an attorney might be a good idea, but 1 year and 27 years of overstay are considered the same for people in your situation.

States vary when it comes to obtaining a DL...plus, it is funny, but in my state, they do check NOW legal presence, and issue a DL accordingly. The time I applied for a DL was when I was 15 years old and they did not check a darn thing. Since then my DL expired a couple hundred times (ok, not a couple hundred, but at least 3 or 4 times) and they never ever wanted to see my "current status"....I just renewed it online all the time. And throughout all these years I have changed my status about three times as well...so I guess government isn't doing their "best" in all states (at least in mine)....

Ohio just started checking for lawful presence in the US. thats why i need to get the green card so i can renew my drivers license next april

So can i travel out of the country when i get my green card?

What will i need to enter the US? Just a green card?

How long should it take for me to get my green card?

Yes, you can travel out of country when you get it - as long as you have what the country you are visiting requires for entry. The green card allows you to get back in the US without issues. Technically, you are only supposed to need the green card, but they always ask me for my (Canadian) passport, too.

AOS typically takes 3-5 months after you send it in.

When an I-485 is denied you are usually placed into removal proceedings if you do not depart the US voluntarily in the prescribed period (usually 30 days from denial) or refile, or file an appeal.
