My friend who is a US Citizen got married (Ceremonial Wedding) in Jan 12th 2013. According to the country where he got married there is a wait time of 15 days to get a marriage license so on his marriage license the marriage date is Jan 27th 2013.

He filed all the paperworks (I-130) stating the marriage date to be Jan 27th based on the license. Will this difference in date cause any issue? I believe no matter when you got married, date on the license is an authentic date of marriage, am i correct?

Thanks,

That is correct.

Your marriage certificate/license (or any govt issued document that proves the date and place of your marriage) is an accepted proof.

Is there any place in any form that the date Jan 12th is mentioned? If not, Jan 27th is the official and as long as all of the dates in the forms submitted by him matches along with his "proof of marriage", he shouldn't face any issues.

This is typical in middle eastern countries too, with one date for traditional wedding and another for official. (As of recently - unless rules changed) The official date is chosen.

Thanks for the comment; yes i looked over his documents and all dates are consistent to 27th.

Will his wife face any problem during interview? What if the CO asks for the marriage date? Should she say 12th or the 27th?

This is one of those issues where someone lied to bypass rules and regulations. And that's never good to lie to immigration.

It's not about its a small lie and they really are married. If the country rule is 15 days but they by pass that then lied to look like they satisfied that well that's on them.

Should she lie no is all i can say.

dwheels76, thanks for the response but maybe am not understanding your comment.

But how is it lying to bypass rules and regulations? Lying is saying something that never happened but the marriage happened one with a ceremonial on the 12th and one in the paper i.e. marriage license (according to the law of the country).

We can tell the CO about both dates, no problem; the fact is that they are married and have all the supporting documents to prove it.

Wheels, the date of marriage given on the I-130 is actually a later date than the actual date of ceremony. What's the OP's friend trying to by pass?

May be you're misreading something dear?

Maybe I am confusing myself. But you said there's a 15 day wait for a marriage license but they got married the 12th. So to look like they meet the requirement of 15 days they said they got married on the 27th. Is this correct.

Than you said "Will his wife face any problem during interview? What if the CO asks for the marriage date? Should she say 12th or the 27th?"

If its all cool why would they be a problem.

no wheels....they know they were married on the 12th in accordance with their customs.

the marriage cert says they were officially married on the 27th. And so thats the date they used on the I-130.

He was asking if thats the correct date of official marriage.

wheels, are you "glug glug gluging" again? mad.gif
