Good morning,

My wife is immigrating legally through a K-1 visa. Recently, Colorado put into place a law allowing illegal immigrants in state tuition rates, but not legal immigrants. I am for everyone getting an education, however I feel we have been discriminated against given; I have brought her legally, she is an immigrant and because she is legally here I must now pay 3 times the tuition of someone who circumvented the proper channels. Thoughts? Help? Suggestions?

How long has your wife been here in the states? And can you show proof of how long she has been in the state of Colorado? If you can prove this, then they should let her get in state tuition. You need to find out what your universities residency proof requirements are, then contact the Director of admissions about your wife.

in texas.. you have to live in the state as a resident NOT a student for one year.. to get residency in the state.. THEN you get in state tuition..

it don't work if you are only in texas to go to school..

so she may have to sit out of school for a year..

Check with the school, if you have a state ID /DL and have lived in the state for over a year she may be able to use your time to count towards her residency to get in-state fees. Depends on the school tho!

In-state tuition fees are applicable to legal immigrants too as much as it is to U.S Citizens AND (now) illegals in CO!

The news about CO made headlines recently because they passed a law to allow illegal (politely called "undocumented") immigrants to be eligible for in-state tuition thus giving them a reason to sue for "discrimination"!

Check with your school/university on the requirements to prove her residency in the state. Typically, it requires one year of residency in a state to be eligible for the "discounted" in-state tuition fees..

My opinion: With the direction we are taking very soon we would/should have a section in VJ forums for "Path from illegal to legal"... describing in details starting from how to become illegal at first place to laying claims to legal status oops8rh.gif

thought - wait a year till she's been a legal resident of the state for that 1 year.

suggestion - check out the community colleges - their rules are less stringent about the 1 year rule

Not necessarily. In Texas, owning a house (i.e. having your name on the deed) would also qualify you for in-state tuition without having to wait for a year. Also, you could theoretically get in-state status if you worked full-time outside the school while still a student (the term the state uses is "gainfully employed" where said employment must not be contingent on student status.)

I read that you work at a university and wanted to ask if it is in CA? or if not, would you know of community colleges/colleges in CA that is good at IT educ but offers affordable fees? or offers grants/scholarships/student aid options to lessen fees? i was just thinking about my fiancee's son and when they both get here after the K1 visa gets approved. thought id check out the options early on the process. thanks in advance for any insights you can share on this.
